NOTICE OF HEARING
CASE 7039 - Petition of Orange County, New York, pursuant to Section 91 of the Railroad Law, for an order of the Commissioner approving the alteration of at grade highway rail crossing (DOT # 263 l 73R -MP 08.20) located at the intersection of Neelytown Road (County Road 99, Town of Montgomery, Orange County) with the railroad tracks of Norfolk Southern.

NOTICE is hereby given that a public hearing will be held in the above-entitled matter before John Mark Noordsy, Administrative Law Judge, New York State Department of Transportation, at the Montgomery Town Hall located at 110 Bracken Road, Montgomery, NY 12549, on September 19, 2025, beginning at 11 :00 AM.
By letter dated January 23, 2025, the County Executive and the County Legislature for Orange County, New York, petitioned the New York State Department of Transportation for a public hearing to consider its request for an Order authorizing the alteration of the traffic control system at the Neelytown Road highway rail crossing by permitting the County to remove the existing traffic control system and related appurtenances and install a new traffic control system. The new traffic control system would include the installation of two traditional railroad crossing automatic gates, supporting masts with flashing lights and bells, signal house, signage, pavement markings, advance warning signs, necessary control equipment and all necessary components and appurtenances. The requested Order would direct Orange County to pay the costs associated with the replacement of the traffic control system at the Neelytown Road highway rail crossing and direct that Norfolk Southern be obligated to maintain and repair the new traffic control system post installation.
This hearing will establish a record and enable a determination as to whether such modifications are in the public interest of the People of the State of New York.
