NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Aurelio N. Estrela and Tammy M. Estrela, to Beneficial Massachusetts, Inc., dated July 26, 2004, and recorded with the Bristol County (Northern District) Registry of Deeds in Book 13916 at Page 194; As affected by a Loan Modification Agreement dated September 4, 2019, and recorded at the Bristol County (Northern District) Registry of Deeds in Book 25460, Page 296, of which mortgage the undersigned is the present holder by assignment from Beneficial Massachusetts, Inc., to U.S. Bank Trust, N.A., as Trustee for LSF8 Master Participation Trust, dated June 24, 2014, and recorded at the Bristol County (Northern District) Registry of Deeds at Book 21763, Page 23, by an assignment from U.S. Bank Trust, National Association, as Trustee for LSF8 Master Participation Trust to Goldman Sachs Mortgage Company, dated February 15, 2019, and recorded at the Bristol County (Northern District) Registry of Deeds in Book 27793, Page 298, by an assignment from Goldman Sachs Mortgage Company to MTGLQ Investors, L.P., dated March 9, 2022, and recorded at the Bristol County (Northern District) Registry of Deeds in Book 27793, Page 300, by an assignment from MTGLQ Investors, L.P., to U.S. Bank Trust National Association, as Trustee of the Tiki Series IV Trust, dated May 4, 2021, and recorded at the Bristol County (Northern District) Registry of Deeds in Book 27793, Page 302, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 A.M. on the 7th day of October, 2025, at 19 Cobbs Lane a/k/a 19 Cobb Lane, Dighton, MA 02715, all and singular the premises described in said mortgage,

The land in Dighton, Bristol County, Massachusetts, with all the buildings and improvements thereon, bounded and described as follows:
Parcel One: The land situated on the Southerly Side of Cobb’s Lane, leading Westerly from Somerset Avenue to the Iron Company Wharf and bounded: Beginning at the Northeast Corner thereof by said land, running thence by land now or formerly of Dighton Stove Lining Company S 23 degrees 10' W, One Hundred Ten (110) feet; thence by said company land and land now or formerly of Manuel Costa, et ux, N 67 degrees 14' W, Two Hundred Eight (208) feet to land now or formerly of Whitmarsh; thence by said Whitmarsh land, N 22 degrees 54 E, One Hundred Ten (110) feet to said land; thence by said land, S 67 degrees 14' E, Two Hundred Eight and Fifty One-hundredths (208.50) feet to the point of beginning.
Parcel Two: beginning at a corner of land formerly of Charles Smith & Company on the northerly side of main street, running thence by said street westerly, forty-six and fifty one-hundredths (46.50) feet to a corner of land formerly of Charles N. Simmons; thence by said Simmons land northerly, One hundred Twenty-Seven (127) feet, westerly Thirty-Three (33) feet to land formerly of Mary McManus; thence by said McManus land, northerly One hundred Ninety-One (191) feet to land above described; thence by said land easterly, Sixty-Five (65) feet to said Dighton stove lining company land; thence by last named land and by said smith & company land southerly, Three hundred Thirty and Fifty One-hundredths (330.50) feet to the point of beginning.
Parcel three: The lot known as Hayden lot on the northerly side of main street containing about one-eighth (1/8th) of an acre, bounded on the south by main street; on the west by George W. Rose land; and on the north and east by Manuel Costa land.
Being the same property conveyed from Antero Pontes, Jr. to Aurelio N. Estrela and Tammy M. Estrela by deed recorded 10/27/95 in Book 6542 at page 185
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
