By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Duarte Cabral and Maria Cabral to Bank of America, N.A., dated April 20, 2009 and recorded in Bristol County (Fall River District) Registry of Deeds in Book 7163, Page 136 (the “Mortgage”) of which mortgage Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as Owner Trustee for Onity Loan Acquisition Trust 2024-HB2 is the present holder by Assignment from Bank of America, N.A. to Champion Mortgage Company dated September 26, 2012 and recorded at said Registry of Deeds in Book 8047, Page 252, and Assignment from Nationstar Mortgage LLC D/B/A Champion Mortgage Company to Bank of America, NA, its successors and assigns dated January 5, 2021 and recorded at said Registry of Deeds in Book 10420, Page 223, and Assignment from Nationstar Mortgage LLC D/B/A Champion Mortgage Company to Bank of America N.A. dated April 29, 2021 and recorded at said Registry of Deeds in Book 10562, Page 275, and Assignment from Bank of America N.A. to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as Owner Trustee for Onity Loan Acquisition Trust 2024-HB2 dated October 3, 2024 and recorded at said Registry of Deeds in Book 11621, Page 84, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 630 Walnut Street, Fall River, MA 02720 will be sold at a Public Auction at 4:00 PM on October 2, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land in said Fall River, together with all the buildings and improvements thereon, situated at the Northwesterly corner of Walnut and Linden Streets, and bounded and described as follows:
Beginning at a point at the Northwesterly intersection of Walnut and Linden Streets, at the Southeast corner of the lot to be described, thence running Westerly by said Walnut Street, Forty-eight and Eighty-seven One-hundredths (48.87) feet to land now or formerly of William J. Hickey; thence running Northerly by said last named land, Seventy-five (75) feet to a drill hole and land now or formerly of C.H. Sears; thence running Easterly by said last named land, Forty-seven and Fifty-nine One-hundredths (47.59) feet to Linden Street; thence running Southerly by Linden Street, Seventy-five feet to the point and place of beginning. Being the same premises conveyed to these Mortgagors by deed of Edward A. Boardman and Claire C. Boardman, dated December 31, 1982, and recorded with the Bristol County Fall River District Registry of Deeds in Book 1419, Page 335.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
