NOTICE OF SALE UNDER POWER
Pursuant to the power of sale contained in the Security Deed executed by GRADY DAILEY to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS GRANTEE, AS NOMINEE FOR ANGEL OAK MORTGAGE SOLUTIONS LLC in the original principal amount of $ 420,000.00 dated January 6, 2023, and recorded in Deed Book 3003, Page 554, Chatham County records, said Security Deed being last transferred to WILMINGTON SAVINGS FUND SOCIETY, FSB, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE OF OBX 2023-NQM5 TRUST in Deed Book 3437, Page 600, Chatham County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 10/07/2025, the property in said Security Deed and described as follows:
ALL THOSE CERTAIN LOTS, TRACTS OR PARCELS OF LAND SITUATE, LYING AND BEING IN THE CITY OF SAVANNAH, CHATHAM COUNTY, GEORGIA, AND BEING KNOWN AND DESIGNATED AS LOTS 37 AND 38, BLOCK 12, GRIMSHAW WARD, UPON THE OFFICIAL MAP OR PLAN OF SAID CITY; SAID LOTS ARE CONTIGUOUS AND FORM ONE BODY OF LAND GENERALLY RECTANGULAR AS A WHOLE ARE BOUNDED AS FOLLOWS: ON THE NORTH BY A LANE; WITH A FRONTAGE
THEREON OF 60 FEET; ON THE EAST BY LOT 36, SAID BLOCK AND WARD, WITH A FRONTAGE THEREON OF 120 FEET; ON THE SOUTH BY 58TH STREET, WITH A FRONTAGE THEREON OF 60 FEET; AND ON THE WEST BY HABERSHAM STREET WITH A FRONTAGE THEREON OF 120 FEET. SAID PARCEL OF LAND IS ALSO SHOWN AS LOT 58, BLOCK 12, UPON A MAP OR PLAT OF POPLAR GROVE RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA, IN PLAT RECORD BOOK B, PAGE 152. SAID MAP OR PLAT IS INCORPORATED HEREIN BY SPECIFIC REFERENCE FOR A MORE COMPLETE DESCRIPTION OF THE PROPERTY HEREIN CONVEYED.
Said property being known as: 202 E 58TH ST, SAVANNAH, GA 31405
To the best of the undersigned’s knowledge, the party or parties in possession of said property is/are GRADY DAILEY or tenant(s).
The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
