NOTICE OF SALE
GEORGIA, CHATHAM COUNTY
By virtue of a power of sale contained in that certain Deed to Secure Debt, Security Agreement, and Assignment of Leases and Rents (the “Deed to Secure Debt”) from Coastal Savannah Homes LLC to Sunnydale Productions, LLC dated March 14, 2024, and recorded in Deed Book 3330 Pages 9, et. seq., Chatham County Deed Records, said Deed to Secure Debt having originally been given to secure that certain Note in the original principal amount of THREE HUNDRED TWENTY ONE THOUSAND FOUR HUNDRED EIGHTY FOUR and 80/100 DOLLARS ($321,484.80) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by Coastal Savannah Homes LLC to Sunnydale Productions, LLC, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Savannah, Chatham County, Georgia, within the legal hours of sale on the first Tuesday in October, 2025, the following described property:
All that certain lot, tract or parcel of land situate, lying and being in the State of Georgia, County of Chatham, known as LOT FORTY (40), VISTA POINT SUBDIVISION prepared for Charles M. Black by Barrett & Exley, Inc., dated May 1974, recorded in Subdivision Map Book J, Page 70, of the Map Records of the Superior Court of Chatham County, Georgia, to which map reference is hereby made for a more particular description of the property herein described.
Said property having an address of 286 Cushing Drive, Savannah, GA 31406, and a property tax number of 10465 04010.
This being the same property conveyed to Carolyn Ellen Stepat and Frederick Otto Stepat, Ill by Limited Warranty Deed from Janet M. Lavely, dated June 26, 2023, and recorded in Deed Book 3128, Page 484, Chatham County records.
Subject, however, to all valid restrictive covenants, easements and rights-of-way of record.
The indebtedness secured by the aforementioned Deed to Secure Debt has been and is hereby declared immediately due and payable in full because of the failure of Coastal Savannah Homes LLC to maintain payments upon said indebtedness owing to Sunnydale Productions, LLC, in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys’ fees.
The above-described real property will be sold as the property of Coastal Savannah Homes LLC and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Deed to Secure Debt described above; and all easements, restrictions, rights-of-way, Deed to Secure Debts or other encumbrances of record which have priority over the referenced Deed to Secure Debt.
To the best of the knowledge and belief of the undersigned, the party presently in possession of said property is Coastal Savannah Homes LLC and/or a tenant or tenants.
Please be further advised that the entity which has full authority to negotiate, amend and modify all terms of the Note, Deed to Secure Debt, and related documents, is:
