NOTICE Franchise Agreement - Liberty Utilities (Litchfield Park Water and Sewer) Corp. and Liberty Utilities (Black Mountain Sewer) Corp. NOTICE IS HEREBY GIVEN that pursuant to the provisions of A.R.S. § 40-283, Liberty Utilities (Litchfield Park Water and Sewer) Corp. – Luke Field and Liberty Utilities (Black Mountain Sewer) Corp. - Enclave at Carefree, a company doing business in Maricopa County, Arizona, has filed application with the Board of Supervisors of Maricopa County, Arizona, for the right, privilege, license and franchise from the County of Maricopa to construct, maintain and operate a public service franchise for twenty-five years or for a period of one (1) year after the franchised area or a portion thereof is annexed by a municipality, whichever is shorter, along, upon, under and across public highways, roads, alleys and thoroughfares (excepting State highways) Within Maricopa County as noted on Attachment No. 1 – Legal Description for Enclave at Carefree on file in the Clerk of the Board of Supervisors Office and retained in accordance with LAPR approved retention schedule, Within Maricopa County as noted on Attachment No. 1 – Legal Description for Luke Field Property on file in the Clerk of the Board of Supervisors Office and retained in accordance with LAPR approved retention schedule, not within the confines of any incorporated city or town, and under such restrictions and limitations and upon such terms as this Board may provide not inconsistent with the law and order and rules of the Arizona Corporation Commission. NOTICE IS FURTHER GIVEN that said Board of Supervisors will consider said franchise as applied for and will impose such restrictions and limitations upon said applicant as to the use of such public highways, roads, alleys and thoroughfares as may be deemed best for the public safety and welfare and to include in such franchise the statutory provisions set forth in A.R.S. § 40-283, requiring the grantee of said franchise to pay such expenses, damages and compensations, if any as may result from the use and operation of said franchise and as in said statute specified. NOTICE IS FURTHER GIVEN that 9:30 A.M., on the 1st day of October 2025, in the Supervisors' Auditorium, 205 W. Jefferson, Phoenix 85003 is hereby fixed as the time and place when said matter will be taken up for consideration and possible granting of said franchise. All persons wishing to appear for or against the proposed franchise are directed to attend the meeting or file a statement in writing with the Clerk of the Board prior to the meeting.
