The land in Gardner, Worcester County, Massachusetts and the building thereon being Lot 1, bounded and described as follows:
Lot 1 shown on a plan entitled : ''Plan of Lots prepared for Anthony A. Alves and Kathleen A. Alves, Gardner, MA.," dated November 2, 1987, contains 40,000 square feet, according to said plan, recorded at Worcester Registry of Deeds in Plan Book 597, Plan 88, bounded and described as follows:
Beginning at the southeasterly corner thereof, at a town line bounded at an angle in the Town line between Gardner and Westminster in the northerly line of Whitney Street at a corner of land of Luc B. & Martha Martin;
THENCE N. 70° 31' 18" W. 31.16 feet;
THENCE N. 84° 03' 35" W. 97.06 feet;
THENCE N. 77° 41' 04" W. 51.89 feet;
THENCE N. 69° 10' 11" W. 119.88 feet to an iron pin at a corner of other land now or formerly of Anthony A. Alves and Kathleen A. Alves, the grantors herein and being shown as lot "2" on plan above referred to, the preceding four course being by said street line;
THENCE N. 15° 04' 59" E. by said Alves land and Lot "2", 255.72 feet to an iron pin in a stone wall in line of land of Bruce C. Gemborys and Christine A. Gemborys;
THENCE S. 35° 23' 13" E. 36.73 feet to a drill hole;
THENCE S. 34° 33' 31" E. 122.50 feet to a drill home at a corner of land of the first mentioned Martin, the preceding two course being by said Gemborys land;
THENCE S. 34° 37' 42" E. by said Martin land 231.16 feet to a town line bound in the aforementioned Gardner-Westminster Town Line and the point of beginning, the preceding three courses being by a stone wall.
This parcel is conveyed subject to and with the benefit of all rights easements and restrictions set forth or referred to of record insofar as the same may now be in force and applicable.

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
