SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS, on August 31, 2017, MICHAEL A LYON, MARRIED MAN, AND MELISSA L. LYON, HIS WIFE, executed a Deed of Trust to FIRST AMERICAN TITLE, as Trustee and, Mortgage Electronic Registration Systems, Inc., solely as nominee for MORTGAGE RESEARCH CENTER, LLC DBA VETERANS UNITED HOME LOANS., A MISSOURI LIMITED LIABILITY COMPANY, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Forrest County, Mississippi, in Book 2140, Page 120 and as Instrument Number 765661; and
WHEREAS, Mortgage Electronic Registration Systems, Inc., solely as nominee for MORTGAGE RESEARCH CENTER, LLC DBA VETERANS UNITED HOME LOANS assigned said Deed of Trust to Nationstar Mortgage, LLC d/b/a Mr. Cooper via an instrument dated March 18, 2019 and recorded in Book 2223, Page 586 in the Office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, Nationstar Mortgage, LLC d/b/a Mr. Cooper appointed McCalla Raymer Leibert Pierce, LLC as Substitute Trustee in place of the afore-mentioned Deed of Trust via an instrument recorded in Book 2257, Page 203 in the Office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, Nationstar Mortgage, LLC d/b/a Mr. Cooper assigned said Deed of Trust to Allied First Bank, SB dba ServBank via an instrument dated March 18, 2019 and recorded in Book 2557, Page 299 in the Office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, the subject mortgage loan was modified via an instrument recorded in Book 2446, Page 332 – and as Instrument No. 841896 - in the Office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, the subject mortgage loan was again modified via an instrument recorded in Book 2562, Page 144 – and as Instrument No. 872035 - in the Office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, ServBank, N.A. substituted Padget Law Group as Trustee in place of the afore-mentioned original Trustee and substitute Trustee via an instrument dated August 21, 2025 and recorded in Book 2594, Page 570 in the Office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and SERVBANK, N.A., as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the Northeast rear entrance of the Paul B. Johnson Chancery Building in Hattiesburg, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on October 10, 2025, to satisfy the indebtedness now due under and secured by said deed(s) of trust.
Padgett Law Group will convey only such title as vested in it as Substituted Trustee.
The premises to be sold are described as:
Lot 19 of Sherwood Forest First Addition as per map or plat thereof on file in the office of the Chancery Clerk of Forrest County, Mississippi;
LESS AND EXCEPT: Begin at the point of intersection of the Easterly line of grantor's property with the present Northerly right of way line of Mississippi Highway No. 42 as shown on the plans for Federal Aid Project No. 46-0063-02-012-10 at Highway Survey Station 19+594.205; from said Point of Beginning run thence South 87°44'40" West along said present Northerly right of way line a distance of 81.991 meters (268.999 feet) to the present Easterly right of way line of Manor Drive; thence run North 02°26'32" West along the present Easterly right of way line of said Manor Drive a distance of 14.760 meters (48.425 feet); thence run North 87°44'40" East along a line that is 30.000 meters (98.425 feet) Northerly of and parallel with the centerline of survey of said project a distance of 81.991 meters (268.999 feet) to the Easterly line of grantor's property; thence run South 02°26'32" East along said Easterly property line a distance of 14.760 meters (48.425 feet) to the Point of Beginning; containing 0.121 hectares (0.299 acres), more or less, and being situated in and a part of Lot 19, Sherwood Forest First Addition Subdivision as recorded in Plat Book 13, Page 6 in the Chancery Clerk's office of Forrest County, Mississippi, Section 34, Township 5 North, Range 12 West.
The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
