NOTICE OF TRUSTEE'S SALE
The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States, at the front entrance of the Fifth District Court – St. George District, 206 W. Tabernacle, Suite 100, St. George, Utah 84770, on October 14, 2025 at 1:00 p.m. of said day for the purpose of foreclosing that certainDeed of Trust with Assignment of Rents (the "Deed of Trust") executed by Broken Kids LLC, a Utah limited liability company, as Trustor, in favor of US Title Insurance Agency, a Utah title insurance agency, as Trustee, for the benefit of Graybird LLC, a Utah limited liability company, as Beneficiary, dated August 30, 2024 and recorded August 29, 2024 as Entry No. 20240027214 in the official records of Washington County, Utah. The real property encumbered by the Deed of Trust is located at approximately 600 North 2170 West, Hurricane, Washington County, Utah, and said property is described more particularly on Exhibit A hereto (collectively, the "Property").
The Notice of Default and Election to Sell was filed for recording with the Washington County Recorder on March 27, 2025 as Entry No. 20250010195.
Trustee will sell the Property at public auction to the highest bidder without covenant or warranty as to title, express or implied, possession, condition or encumbrances, including fees, charges, and expenses of the Trustee and of the trust created by said Deed of Trust, to pay the remaining sums owing under the promissory note secured by said Deed of Trust, including delinquent property taxes.
The sale is subject to a bankruptcy filing, a payoff, or any other condition of which the Trustee is not aware thatwould cause the cancellation of the sale. If any such condition exists, the sale shall be void, the successful bidder's funds returned and the Trustee, and current beneficiary shall not be liable to the successful bidder for any damage.
The current beneficiary of the Deed of Trust is Providence Lending Fund, LP. The purported owner of the Property as of the recording of the notice of default is Broken Kids, LLC.
Bidders must be prepared to tender to the trustee a $100,000.00 cashier's check at the sale and a cashier's check forthe balance of the purchase price within 24 hours after the sale.
