NOTICE AND ORDER
TO RAZE OR REPAIR

The City of Oshkosh Inspection Services Division recently inspected the premises located at 1313 Liberty Street, City of Oshkosh, Winnebago County, Wisconsin, parcel number 912-0399, more particularly described as follows:
The South Fifty (50) feet, front and rear, of Lot Four (4) of Block One Hundred Thirty (130) in the Twelfth Ward, City of Oshkosh, Winnebago County, Wisconsin, per Leach's Map of 1894.
The building on the premises was the site of a structure fire in the spring of 2025 and suffered significant damage. As a result, the undersigned has determined that the building on such premises is old, dilapidated, or out of repair and consequently dangerous, unsafe, unsanitary, or otherwise unfit for human habitation, occupancy or use. The undersigned has further determined that the building must be made safe and sanitary through reasonable repairs, or, the building must be razed and the site returned to a dust-free and erosion-free condition.
THEREFORE, IT IS ORDERED, pursuant to the authority set forth in Wis. Stat. § 66.0413(1)(b), within thirty (30) days following the service of this Notice and Order upon you, you shall repair the building and make the building safe and sanitary as follows:
1. A licensed building contractor shall apply for and receive a building permit for the reconstruction of the building. As part of the submission for the building permit, structural calculations shall be provided confirming the integrity of the structural components, including, but not limited to, the beams, floor joists, ceiling joists, and headers. All repairs shall comply with state and municipal building codes.
2. A licensed electrical contractor shall apply for and receive an electrical permit for repair or replacement of the electrical system. If the electrician chooses to utilize any component of the existing electrical system (as opposed to a complete replacement) the electrician shall evaluate the existing system and ensure that all components are installed and capable of functioning in a code compliant condition. Any damaged or missing component, including any fire damaged service panels and breakers, shall be repaired or replaced. All repairs shall comply with state and municipal building codes.
3. A licensed plumber shall apply for and receive a plumbing permit for repair or replacement of the plumbing system. If the plumber chooses to utilize any component of the existing plumbing system (as opposed to a complete replacement) the plumber shall evaluate the existing system and ensure that all components are installed and capable of functioning in a code compliant condition. Any damaged or missing component in the plumbing system shall be repaired or replaced. All repairs shall comply with state and municipal building codes.
4. A licensed heating contractor shall submit for and receive a permit for repair or replacement of the heating system. If the licensed heating contractor chooses to utilize any component of the existing heating system, the contractor shall ensure that all components are installed and capable of functioning in a code compliant condition. Any damaged or missing component in the HVAC system, including the furnace, shall be repaired or replaced. All repairs shall comply with state and municipal building codes.
5. The repair and replacement work shall be completed per the approved permits listed in #1-#4 above within thirty (30) days following the service of this Notice and Order upon you.
Or, alternatively, you shall raze the building and remove the rubble and remains thereof, and any excavation caused by such razing shall be filled and leveled and the site restored to a dust-free and erosion-free condition within thirty (30) days following the service of this Notice and Order upon you.
NOTICE IS GIVEN, if you refuse or fail to repair the building or raze the building and return the site to a dust-free erosion free condition within the thirty (30) day period prescribed, the City of Oshkosh, Winnebago County, Wisconsin, may cause such building or part thereof to be razed and removed and the site restored to a dust-free and erosion-free condition. The City's work shall consist of securing the real estate and then razing and removing the subject structure and all outbuildings, accessory structures, flatwork, and driveway aprons and filling all basements and excavated areas with approved granular material, topsoil, and seed. The costs of securing the real estate and the costs of razing, removal and restoration may be charged in full or in part against the real estate upon which the building is located and if that cost is so charged, it is a lien upon such real estate, and may be assessed and collected as allowed under Wis. Stat. § 66.0413(1)(f).
YOU ARE FURTHER ORDERED AND NOTIFIED, that if you refuse or fail to repair or raze the building, pursuant to the authority set forth in Wis. Stat. § 66.0413, you shall remove all personal property and fixtures from the building within thirty (30) days following service of this Notice and Order. If you refuse or fail to remove the personal property and fixtures from the building, any personal property and fixtures may be stored, sold, or if they have no appreciable value, destroyed by the City of Oshkosh. If the personal property or fixtures are stored, the amount paid for storage shall be a lien against the personal property and against the real estate and shall be assessed and collected as a special tax against the real estate if the real estate is owned by the owner of the personal property and fixtures. If personal property or fixtures are stored by the City of Oshkosh and not claimed by you, they may be sold or disposed of at the expiration of 6 months after they have been stored.
NOTICE IS FURTHER GIVEN that pursuant to Wis. Stat. § 66.0413(1)(h) you may challenge this Notice and Order, which is an exclusive remedy.
