COMMON COUNCIL Official Proceedings of the Twelfth Common Council Meeting of the City of Sheboygan. The Council met: September 15, 2025 Mayor Ryan Sorenson in the chair. The following Ald. were present: Dekker, Belanger, Close, Heidemann, Mitchell, La Fave, Menzer, Perrella, Boorse, and Rust – 10. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES On motion by Dekker/Perrella, the reading of minutes of the Eleventh Regular Council Meeting held September 2, 2025 was approved as entered on the record, all Ald. voting "Aye." CONFIRMATION OF MAYORAL APPOINTMENT Katy Ries to the Mayor's International Committee. Motion by Dekker/Perrella to confirm. All ayes. ELECTION TO BOARD OF WATER COMMISSIONERS Motion by Dekker/Perrella to receive nominations from the floor, voting to be done by open ballot, and if two or more candidates are nominated, the candidate with the lowest number of votes be dropped from the list, and balloting to continue until one candidate receives a majority. Motion by Dekker/Perrella to nominate Gerald Van De Kreeke. No other nominations were received. Motion by Dekker/Perrella to instruct the City Clerk to cast a unanimous ballot for Gerald Van De Kreeke as the Representative on the Sheboygan Board of Water Commissioners. All ayes. PUBLIC FORUM No one spoke. MAYOR'S ANNOUNCEMENTS Upcoming Community Events, Proclamations, Employee Recognitions Consent Agenda - Motion by Dekker/Perrella to receive and file all reports. All were passed on call of the roll. All ayes. (*=Consent items) HEARING No. 7-25-26 pursuant to a notice published and letters sent, this hearing is for the purpose of allowing interested parties to be heard relative to the vacating and discontinuance of a portion of right-of-way on the east side of North 5th Street adjacent to Lot 1, Block 5 of the Assessment Subdivision No. 21, City of Sheboygan. Bill Rees spoke. Motion by Dekker/Perrella to close hearing. All ayes. REPORTS Passed: *Report 13-25-26 by City Clerk submitting a license application. *Report 14-25-26 by Comptroller Evan Grossen pursuant to Sheboygan Municipal Code § 2-912(b), which requires the comptroller to file with the common council, not less than monthly, a list of the claims approved, showing the date paid, the name of the claimant, the purpose and the amount, the attached list of paid vouchers for June 2025 is being provided. *Report 15-25-26 by Comptroller Evan Grossen pursuant to Sheboygan Municipal Code § 2-912(b), which requires the comptroller to file with the common council, not less than monthly, a list of the claims approved, showing the date paid, the name of the claimant, the purpose and the amount, the attached list of paid vouchers for July 2025 is being provided. *Report 17-25-26 by Board of License Examiners submitting applications for Building Contractor License already granted. Report 16-25-26 by Licensing, Hearings, and Public Safety submitting Findings of Fact and Conclusions of Law based upon testimony and exhibits presented at a Quasi-Judicial Hearing held on August 25, 2025 regarding the licenses held by J.N. Cortez LLC, D.B.A. Mi Ranchito II (License #3475) in the City of Sheboygan. Motion by Rust/La Fave to receive and accept the findings of fact. All ayes. Motion by Perrella/Boorse to accept the recommendations, including suspension, from committee. Before action was taken, motion by Dekker/Belanger to revoke the liquor license. Ayes: 5 (Belanger, Dekker, Heidemann, Menzer, Mitchell). Nays: 5 (Boorse, Close, La Fave, Perrella, Rust). Mayor voted Nay to break the tie vote. On original motion to accept the recommendations, including suspension. Ayes: 7 (Boorse, Close, Dekker, La Fave, Mitchell, Perrella, Rust). Nays: 3 (Belanger, Heidemann, Menzer). RESOLUTIONS Passed: No. 93-25-26 by Ald. Dekker and Perrella commemorating the distinguished service of Barbara Felde to the City of Sheboygan. Motion by Dekker/Perrella to adopt Resolution. All ayes. No. 94-25-26 by Ald. Dekker and Perrella authorizing the appropriate City officials to sign the January 1, 2024 -December 31, 2028 Contract between the City of Sheboygan and International Association of Firefighters - Local 483. Motion by Dekker/Perrella to suspend the rules and adopt the Resolution. All ayes. No. 90-25-26 by Ald. Dekker and Rust designating the City Forester as the City's Authorized Representative for the purpose of Wisconsin Department of Natural Resources (WI DNR) Urban Forestry Grants for calendar year 2026 and directing him to submit an Urban Forestry Grant Application. Motion by Dekker/Rust to adopt the Resolution. All ayes. No. 91-25-26 by Ald. Dekker and Rust authorizing the appropriate City officials to enter into contract for the demolition and associated site restoration of the City owned property located at 930 N. 8th Street and contiguous city owned property to the west of the former hotel and restaurant to clear the land for future development. Motion by Dekker/Rust to adopt the Resolution. All ayes. No. 92-25-26 by Ald. Mitchell and Perrella authorizing the appropriate City officials to enter into a renewal contract with Cities and Villages Mutual Insurance for Public Entity Liability Insurance. Motion by Mitchell/Perrella to adopt the Resolution. All ayes. No. 74-25-26 by Ald. Dekker and Rust vacating a 0.03 acre portion of right-of-way on the east side of North 5th Street adjacent to Lot 1, Block 5 of the Assessment Subdivision No. 21, City of Sheboygan, Sheboygan County, Wisconsin. Motion by Dekker/Rust to adopt the Resolution. Before action was taken, motion by Dekker/Rust to amend Resolution to change the word in the final "Be it Further Resolved" paragraph from "alley" to "property". All ayes. On motion to adopt the Resolution as amended, All ayes. GENERAL ORDINANCES Passed: No. 15-25-26 by Ald. Rust and La Fave amending sections of the Sheboygan Municipal Code related to dog kennel licenses and animal fancier permits. Motion by Rust/La Fave to adopt Ordinance. All ayes. Refer to City Plan Commission: No. 16-25-26 by Ald. Menzer and Close annexing territory to the City of Sheboygan, Wisconsin (Parcel No. 59024341782). CHARTER ORDINANCE Passed: No. 3-25-26 by Ald. Dekker and Perrella (being subject to the home rule provisions of § 66.0101 of the Wisconsin Statutes) to authorize primary elections whenever three or more candidates file nomination papers for an elective city office. Motion by Dekker/Perrella to adopt the Charter Ordinance. All ayes. REPORT OF COMMITTEE Passed: No. 23-25-26 by Finance and Personnel to whom was referred Direct Referral Gen. Ord. No. 6-25-26 by Ald. Dekker and Mitchell amending, repealing, and recreating provisions related to the manner of selection and tenure of the City Attorney.; recommends adopting the Ordinance. Motion by Mitchell/Dekker to receive the R. C. and adopt the Ordinance. Before action was taken, motion to add section to Ordinance to read that the City Attorney will report to and be evaluated by the Common Council with input and guidance from the City Administrator, Mayor, and Director of Human Resources. Motion made by Perrella, failed due to lack of second. On motion to adopt Ordinance, Ayes: 9. Nay: 1 (Perrella). Filed: No. 25-25-26 by Finance and Personnel to whom was referred Direct Referral Res. No. 19-25-26 by Ald. Mitchell and Perrella authorizing the appropriate City officials to sign the January 1, 2024 - December 31, 2028 Contract between the City of Sheboygan and International Association of Firefighters - Local 483; recommends amending the package proposal in Article 25, Section A (1) to read, "Unused sick leave may be accumulated up to a maximum of one thousand seven hundred twenty-eight (1,728) hours". Motion by Mitchell/Perrella to file. All ayes. CLOSED SESSION Motion by Dekker/Perrella to convene in closed session under the exemption contained in Wis. Stat. s. 19.85(1)(g) when conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, to wit: possible action regarding various licenses held by J.N. Cortez, LLC, D.B.A. Mi Ranchito II. Ayes: 9. Nay: 1 (Rust). OPEN SESSION Motion by Dekker/Perrella to reconvene in open session for discussion and possible action relating to closed session.
