Foley to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Countrywide Bank, FSB, its successors and assigns, dated January 2, 2008 and recorded in Plymouth County Registry of Deeds in Book 35478, Page 257 (the “Mortgage”) of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB, its successors and assigns to Green Tree Servicing LLC dated June 14, 2013 and recorded at said Registry of Deeds in Book 43217, Page 185, and Assignment from Ditech Financial LLC f/k/a Green Tree Servicing LLC to New Residential Mortgage LLC dated August 28, 2017 and recorded at said Registry of Deeds in Book 48850, Page 160, and Assignment from New Residential Mortgage LLC to Ditech Financial LLC dated May 24, 2018 and recorded at said Registry of Deeds in Book 49837, Page 31, and Assignment from New Residential Mortgage LLC to Ditech Financial LLC dated June 15, 2018 and recorded at said Registry of Deeds in Book 50410, Page 57, and Assignment from Ditech Financial LLC to Federal National Mortgage Association dated November 30, 2021 and recorded at said Registry of Deeds in Book 56094, Page 223, and Assignment from Federal National Mortgage Association to J.P. Morgan Mortgage Acquisition Corp. dated November 12, 2021 and recorded at said Registry of Deeds in Book 56216, Page 85, and Assignment from J.P. Morgan Mortgage Acquisition Corp. to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF2 Acquisition Trust dated February 13, 2024 and recorded at said Registry of Deeds in Book 58709, Page 303, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 77 Brookfield Drive, Brockton, MA 02302 will be sold at a Public Auction at 12:00 PM on October 10, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon situated on Brookfield Drive, Brockton, Plymouth County, Massachusetts, being shown as Lot 1093 on a plan entitled "Section I, Brookfield Heights at Brockton, Mass., Owned by Braintree Homes, Inc., dated December 15, 1956m Bradford Saivets, Civil Engineer", duly recorded with Plymouth Registry of Deeds as Plan No. 4 of 1960, Plan Book 11, Page 839, to which plan reference is hereby made for a more particular description. Excluding any portion of the premises subject to the takings recorded in Book 14791 at Page 135 and in Book 18467 at Page 161.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 4236, Page 456.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
