By virtue and in execution of the Power of Sale contained in a certain mortgage given by Melissa A. Barrett and Matthew W. Barrett to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Mortgage Network, Inc., and now held by U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust, said mortgage dated April 27, 2007 and recorded in the Essex County (Southern District) Registry of Deeds in Book 26801, Page 274, as affected by a Loan Modification dated July 22, 2016 and recorded in the Essex County (Southern District) Registry of Deeds in Book 35220, Page 397; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Network Inc. to OneWest Bank, FSB by assignment dated August 13, 2010 and recorded with said Registry of Deeds in Book 29847, Page 31; said mortgage was assigned from CIT Bank, N.A. (Formerly Known OneWest Bank, N.A. Formerly Known As OneWest Bank, FSB) to CIT Bank, N.A. (Formerly Known as OneWest Bank, N.A. Formerly Known As OneWest Bank, F.S.B.) by assignment dated August 24, 2016 and recorded with said Registry of Deeds in Book 35220, Page 395; said mortgage was assigned from CIT Bank, N.A. f/k/a OneWest Bank, N.A. f/k/a OneWest Bank, FSB to U.S. Bank National Association, not in its individual capacity but solely as trustee for the RMAC Trust, Series 2016-CTT by assignment dated February 1, 2021 and recorded with said Registry of Deeds in Book 39627, Page 490; said mortgage was assigned from U.S. Bank National Association, not in its individual capacity but solely as trustee for the RMAC Trust, Series 2016-CTT to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust by assignment dated November 18, 2022 and recorded with said Registry of Deeds in Book 41356, Page 414; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on October 20, 2025 at 02:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
A parcel of land, situated on Village Street, Marblehead, Essex County, Massachusetts, and being shown as Lot C on "Plan of land in Marblehead owned by Matthew W. Barrett, Trustee of Sunset Slope Realty Trust", dated February 12, 1996, drawn by H&R Survey, and recorded with the Essex South District Registry of Deeds in Plan Book 306, Plan 4 to which reference is hereby made for a more particular description.
For our title see deed recorded with said Deeds in Book 15257, Page 268.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated November 18, 1998 and recorded in the Essex County (Southern District) Registry of Deeds in Book 15257, Page 268.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
