NOTICE OF FORECLOSURE BY ADVERTISEMENT
Default having been made in the conditions of a certain Mortgage made by OSCAR HERRERA,
797 N. Snow Prairie Rd., Union City, MI 49094 to Southern Michigan Bank & Trust, 51 West
Pearl Street, Coldwater, MI 49036 dated January 15, 2021, and recorded in the office of the
Register of Deeds for the County of Branch County and State of Michigan, on January 22, 2021
in Document Number 2021-00500, Branch County Records, and on which Mortgage there is
claimed to be due on the date of this notice, for principal and interest the sum of One Hundred
Forty-Three Thousand Five Hundred Forty-Nine and 44/100 ($143,549.44) Dollars on the
mortgage and no proceedings having been instituted to recover the debt now remaining secured
by said Mortgage, or any part thereof, where by the power of sale contained in said Mortgage
has become operative;
Now Therefore, Notice is Given that by virtue of the power of sale contained in said
Mortgages and under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL
600.3212, the said Mortgage will be foreclosed by a sale of the mortgaged premises therein
described or so much thereof as may be necessary, at a public auction sale, to the highest bidder
for cash or cashier's check, on at the East Entrance of the Courthouse in the City of Coldwater, and
County of Branch, Michigan, that being the place of holding Circuit Court in and for said County,
on October 16, 2025 at promptly 10:00 a.m., which said mortgage premises are described as
follows, to-wit:
The land referred to in this policy, situated in the Township of Union, County of Branch, State of
Michigan, is described as follows:
A parcel of land 240 feet North and South by 340 feet East and West in the Northwest corner of
the Northwest 1/4 of the Northwest 1/4 of Section 34, Town 5 South, Range 7 West, Union
Township, Branch County, Michigan.
Included is a 1997 Fleetwood manufactured home, serial number INFLVA/B04360BJ13, which is
situated on and affixed to the real estate.

Said premises will be sold to pay the amount as aforesaid then due on said Mortgage
together with 2.875% percent interest on the Mortgage, legal costs, attorneys' fees and also any
taxes and insurance that said Mortgagee does pay on or prior to the date of said sale. The amount
due on said Mortgage may be greater on the day of the sale. Placing the highest bid at the sale
does not automatically entitle the purchaser to free and clear ownership of the property. A
potential purchaser is encouraged to contact the county register of deeds office or a title insurance
company, either of which may charge a fee for this information.
Pursuant to MCL 600.3240, the last day to redeem the Sheriff's Deed will be April 16,
2026, however, if an Affidavit of Abandonment is filed with the Register of Deeds, the last day
to redeem will be November 16, 2025, or until the time to provide the notice was required by
MCL 600.3241a(c) expires, whichever is later.
If said property is in fact sold at the above-described foreclosure sale, pursuant to
MCL 600.3278, the above listed Mortgagor will be responsible to the person who buys the
property at the foreclosure sale or to Southern Michigan Bank & Trust for damaging the
property during the redemption period.
ATTENTION PURCHASERS: This sale may be rescinded by the foreclosing
mortgagee. In that event, your damages, if any, shall be limited solely to the return of the bid
amount tendered atsale, plus interest.
