By virtue of and in obedience to a directed to me by the Honorable ASCENSION 23RD JUDICIAL DISTRICT COURT in and for the PARISH OF ASCENSION, State of Louisiana, dated: Thursday, January 30, 2025, in the above entitled and numbered cause, I shalI proceed to sell at public auction at Governmental Annex 828 South Irma Blvd Gonzales, LA 70737 of which the Civil District Court of the Parish of Ascension is held on WEDNESDAY, OCTOBER 29, 2025, at 10:00 AM, to the last and highest bidder for cash, the following described property, to wit:
LOT 1:
A certain lot of ground in the Town of Donaldsonville, Parish of Ascension, Louisiana, designated as Lot one (1) fronting on Lessard Street, being bounded on one side by Lot L and the Lot sold to the Bank of Ascension and now owned by First National Bank, and on the other side by Lot Two (2) and in the rear by Lot Number Seventy (70). Said lot being also shown on a sketch of Daney and Waddell Engineers, record in COB 55, Folio 458, which lot has a width of 64’0”2” on Lessard street by a depth of 171’11”6”’ on the line dividing Lot One from Lots Two and Five and a depth of 168’11”0”’ on a line bounded by Lots 00 and 0, and having a width in the rear of 63’11”03”’.
LOT 0:
A certain piece or parcel of real estate, situated in the Parish of Ascension, State of Louisiana, together with all buildings, improvements, rights, ways and servitudes, thereon belonging, being described as a certain lot in the City of Donaldsonville, in that Square bounded by Mississippi Street, Lessard and Iberville Streets, and Railroad Avenue, designated as Lot No. Zero, measuring fifty feet (50’) front, more or less, on Mississippi Street by a depth of 120 feet, and bounded on the West by Lot 1 and on the East by Lot No. Double Zero, and in the rear by lot also designated as Lot No. 1, known as “Maurin Store Property”.
A certain lot of ground situated in the town of Donaldsonville, Parish of Ascension, and forming the corner of Mississippi Street and Lessard Street and having a frontage on Mississippi of 48’9”6”’, a depth on its upper line of 163’9”4”’, a width on its rear line of 56’7”4”’, and a depth along Lessard Street of 169’6”2”’ all as with greater certainty appear by reference to the survey and sketch made by Daney, civil Engineer, on March 29, 1911. The lot herein described being designated on said sketch by the Letter “B”, and being a portion of the lot acquired by the late Marx Israel from Jean Leon Lacroix by Act of Sale executed before Henry L. Duffel, Notary Public, on December 14, 1866, and recorded in Conveyance Book 28, Folio 317;
LESS the following described lot of ground sold by the Ascension Bank & Trust Co. to Adolphe Netter on June 16, 1911, recorded in conveyance Book 55, Folio 524:
A certain lot of ground together with all rights, ways, privileges, servitudes and advantages thereunto belonging or in anywise appertaining, situated in that part of Donaldsonville, formerly known as Unionville or Faubourg Lessard in Square bounded by Mississippi, Lessard and Iberville Streets, and Railroad Avenue, formerly Cabahanossee Street. Said lot of ground is triangular in shape and measures from an iron pipe set on the woods side line of Mississippi Street at a distance of 48’9”9”’ from the corner of Lessard and Mississippi Streets on a line towards Iberville Street and parallel with Railroad Avenue 163’9”4”’ to an iron pipe thence on a line towards Lessard Street 163’11”3”’ to the Point of Beginning. Said lot is designed by letter “N” and colored yellow on a plan by L. Daney, Civil Engineer and Surveyor, dated June 7, 1911, Said Lot “N” being formed of the upper part of Lot designated by the Letter “B” on a certificate of survey by the same L. Daney, dated 29th March, 1911, and annexed to an act of sale J. Labermuth et als to Bank of Ascension on April 21,1911, executed before Walter Lemann, Notary Public together with all buildings and improvements thereon and thereunto belonging; also one large steel lined vault with large Mosler door and time locks, one boiler, nine steam radiators, tow toilets, three lavatories, one master clock with accessories, one outside dummy clock, various and sun dry lighting fixtures and one set of marble fixtures and cages.
Lot L:
A certain lot of ground situated in the Town of Donaldsonville, Parish of Ascension, Louisiana, in the square bounded by Mississippi, Lessard, Railroad Avenue and Iberville Streets, and fronting on Mississippi and having a width of 59’4”5”’ by a depth on its upper line of 157’0”5”’, a width on its rear line 59’ and a depth on its lower line of 163’9”4”’, the said lower line being the dividing line between the said lot herein described and the lot sold to the Bank of Ascension, and now owned by the First National Bank, together with all the buildings and improvements thereon and thereunto appertaining. This lot being designated on the sketch and survey made by Daney and Waddill Bank of Ascension of date April 21, 1911, recorded in COB 55, Folio 458, and being Lot “L” and being a portion of the lot acquired by the late Marx Israel from Jean Leon Lacroix on December 24, 1866, by act of ale recorded in COB 28, folio 317.
The above lots together are more fully described in a survey by David l Patterson, P.L.S, dated March 26, 2007, as follows:
Lots “1”, “B”, “L”, and “0”, Square 40, located in Section 24, T-11-5, R-15-E, West of the Mississippi River, City of Donaldsonville, Ascension Parish, Louisiana, which tract forms the corner of Lessard and Mississippi Streets and measures 161.82 feet from on Mississippi Street, 173.18 feet in the rear, by a depth and front on Lessard Street of 232.68 feet and a depth on the opposite side of 214.83 feet.
Said property is subject to restrictions contained in that certain Cash Sale without Warranty by Whitney National Bank to Union Landing, L.L.C., dated April 26, 2007, and recorded on April 30, 2007, at COB Instrument No. 00666574 of the official records of Ascension Parish, Louisiana.
And from the proceeds of said sale to pay petitioner by preference over all other claims, the sum of: EIGHT HUNDRED SIXTY NINE THOUSAND EIGHT HUNDRED SEVENTY DOLLARS AND TWENTY THREE CENTS ($869,870.23) DOLLARS, along with
interest and attorney's fees and all other costs including my own costs and charges.
