NOTICE OF PUBLIC HEARING WITH REGARD TO A PETITION TO VACATE PUBLIC WAYS IN THE TOWN OF EATON, INDIANA
A petition has been filed with the Town Council for the Town of Eaton, Indiana, seeking to have vacated certain platted unimproved public ways within the corporate limits of the Town of Eaton, Indiana, which public ways include: a portion of the 15-foot-wide alley west of Liberty Street and running east and west between Lots 161 through 172 of the Mississinewa Land and Improvement Company's Second Addition to the Town of Eaton, Delaware County, Indiana. The portions of such public ways to be vacated are more particularly described as follows:
Beginning at a 5/8 inch rebar at the Southwest corner of Lot 162 of the Mississinewa Land and Improvement Company's Second Addition to the Town of Eaton; thence North 89 degrees 51 minutes 02 seconds East 106.00 feet (assumed bearing) to the Southeast comer of Lot 161; thence South 00 degrees 20 minutes 11 East 7.50 feet along the Southern extension of the East line of said Lot 161; thence South 89 degrees 51 minutes 02 seconds West 106.00 feet along the center of a 15 foot wide alley; thence North 00 degrees 20 minutes 11 seconds West 7.50 feet to the point of beginning.
ALSO, beginning at a 5/8 inch rebar at the Southeast corner of Lot 163 in the Mississinewa Land and improvement Company's Second Addition to the Town of Eaton; thence South 00 degrees 20 minutes 11 seconds East 7.50 feet (assumed bearing) along the Southern extension of the East line of said Lot 163; thence South 89 degrees 51 minutes 02 seconds West 53.00 feet along the center of a 15 foot wide alley; thence North 00 degrees 20 minutes 11 seconds West 7.50 feet to the Southwest corner of said Lot 163; thence North 89 degrees 51 minutes 02 seconds East 53.00 feet to the point of beginning.
ALSO, beginning at the Northwest corner of Lot 170 of the Mississinewa Land and Improvement Company's Second Addition to the Town of Eaton; thence North 00 degrees 20 minutes 11 seconds West 7.50 feet (assumed bearing) along the West line of said Lot 170 extended North; thence North 89 degrees 51 minutes 02 seconds East 159.00 feet along the center of a 15 foot wide alley; thence South 00 degrees 20 minutes 11 seconds East 7.50 feet to the Northeast corner of Lot 172 of said addition; thence South 89 degrees 51 minutes 02 seconds West 159.00 feet to the point of beginning.
A public hearing has been scheduled regarding said Petition on the 14th day of October 2025, at 5:50 P.M. before the Town Council of the Town of Eaton, Indiana, at the Eaton Community Building, located at 600 E. Harris St., Eaton, Indiana 47338. At the time fixed for hearing, or at any time prior thereto, any person interested in the proceedings may file a written remonstrance with the President of the Town Council or the Town Clerk-Treasurer. During said hearing, which may be adjourned from time to time, the Town Council will hear from any persons interested in the proceedings and will read each remonstrance that has been filed prior thereto, all as provided by law. After the public hearing, the Town Council may, by ordinance, vacate the property proposed to be vacated.
