Default having been made in the payment of the indebtedness secured by that certain mortgage dated December 13, 2022, executed by KC Home and Investments LLC, an Alabama limited liability company, to Velocity Commercial Capital, LLC, a California limited liability company, which mortgage was recorded on December 16, 2022, in REAL Book 05914, Page 362 Instrument Number 32014603407, of the mortgage records in the Office of the Judge of Probate of Montgomery County, Alabama and which mortgage was duly transferred and assigned to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as owner trustee for Verus Securitization Trust 2023-4, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Montgomery County Courthouse (Phelps-Price Justice Center) at Montgomery, Alabama during the legal hours of sale on October 22, 2025, the following described real estate, situated in Montgomery County, Alabama, to-wit:

Lot 45, in Block 1, according to the Plat of Grove Hill Estates Plat No. 1, located in the NW 1/4, Section 21, T16, R18, Montgomery Alabama, as recorded in the Office of the Judge of Montgomery County, Alabama, in Play Book 14, at Page 93.

Lot 10, Block A, according to the Plat of South Fairview, as the same appears of record in the Office of the Judge of Probate of Montgomery County, Alabama, in Plat Book 6, Page 69 PARCEL 3: 2339 St Charles Avenue, Montgomery, AL 36107 Parcel # 10 02 09 2 012 018.000 Lot 14, according to the Plat filed by Joseph Lee Rhodes in the Office of the Judge of Probate of Montgomery County, Alabama, and recorded therein in Plat Book 2, at Page 75. The said Plat as filed by Joseph Lee Rhodes being a resubdivision of Lots Number 1, 2, 3, 4, and 5 of Block 47, and also the north 370 feet of the unplatted lot marked "Massey Wilson" all on the Plat of Capitol Heights as the same appear of record in the Office of the Judge of Probate of Montgomery County, Alabama, in Plat Book 2, at Pages 34 and 35. And also a thirty five foot strip of land lying in front of Lot 14, said strip of land being a part of a thirty five foot private right of way shown on the plat filed by Joseph Lee Rhodes on May 14, 1907, and recorded in the Office of the Judge of Probate of Montgomery County, Alabama, In Plat Book 2, at Page 75, thereafter vacated by agreement to vacate easement filed for record in the Office of the Judge of Probate of Montgomery County, Alabama, in Real Property Book 940, at Page 536 on March 16, 1988 at 2:21 p.m.

Lot Number 1, in Block Number 3, according to the Plat of Southmont Subdivision No. 1, as Plat of said subdivision appears of record in the Office of the Judge of Probate of Montgomery County. Alabama, in Plat Book 7, at Page 18, also being Lot Number 1, in Block Number 3, according to the Plat of Southmont Subdivisions 1, 2,3 & 4, as the same appears of record in said Probate Office in Plat Book 7. at Page 53.
This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
