Default has occurred in the conditions of a mortgage made by PRESTON S. OSTRANDER and CASSANDRA L. OSTRANDER, husband and wife, Mortgagor(s), to INDEPENDENT BANK, having its principal office at 4200 East Beltline, Grand Rapids, MI 49525, Mortgagee, dated January 9, 2019 and recorded January 14, 2019 in Liber 653 of Mortgages, Page 2626. By reason of such default the undersigned elects to declare the entire unpaid amount of said mortgage due and payable forthwith.
Notice of Foreclosure By Advertisement. Notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at the south main entrance of the Ionia County Courthouse, 100 W Main St, Ionia, MI 48846, the place of holding the Circuit Court in Ionia County, starting promptly at 10:00 a.m., on November 6, 2025. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the County Register of Deeds Office or a title insurance company, either of which may charge a fee for this information. Notice is hereby given that by virtue of the power of sale contained in said mortgage and under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, the statute in such case made and provided and to pay said amount with interest as provided in said mortgage, and all legal costs, charges, and expenses, including attorney fees allowed by law.
At the date of this Notice there is claimed to be due for principal and interest on said mortgage the sum of ONE HUNDRED TWO THOUSAND TWO HUNDRED FIFTY-NINE and 96/100 ($102,259.96) dollars, including interest at the rate of 7.5% per annum. No suit or proceeding at law has been instituted to recover the debt secured by said mortgage or any part thereof.
Pursuant to Public Act No. 104, Public Acts of 1971 [MCLA 600.3240, MSA 27A.3240] the redemption period shall be 6 months from the date of the foreclosure sale, unless the property is determined to be abandoned under MCLA 600.3241a; MSA 27A.3241(1), in which case the property may be redeemed during the 30 days immediately following the sale or expiration of statutory notice period.
If the property is sold at foreclosure sale under Chapter 32 of the Revised Judicature Act of 1961, pursuant to MCl 600.3278 the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period.
The premises covered by said mortgage are situated in the Township of Otisco, County of Ionia, State of Michigan, described as follows, to wit:
A parcel of land commencing at the Southwest Corner of the Southwest 1/4 of the Southeast 1/4 of Section 5, Town 8 North, Range 8 West, Otisco Township, Ionia County, Michigan; thence East along the South section line 871.2 feet; thence North parallel with the North and South 1/4 line 500 feet; thence West parallel with the South Section line 871.12 feet; thence South along the North and South 1/4 line 500 feet to the point of beginning, EXCEPT the West 1/2 thereof.
