NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 07/20/2004, CLIFTON E. GRANDERSON executed a Promissory Note payable to the order of Novastar Mortgage, Inc., as Lender.
WHEREAS, the aforesaid Promissory Note was secured by a Deed of Trust dated 07/20/2004, executed by CLIFTON E. GRANDERSON AND BARBARA GRANDERSON and being recorded on 07/20/2004 in Book 6088, Page 445 as Document No. 0906494 of the records of the Hinds County, State of Mississippi; and which aforesaid Instrument conveys to RICHARD A. LINLEY ATTY AT LAW, Trustee and to Novastar Mortgage, Inc., as Lender, Mortgage Electronic Registration Systems, INC., as Beneficiary, the hereinafter described property; and
WHEREAS, Mortgage Electronic Registration Systems, Inc., acting solely as nominee for Novastar Mortgage, INC. assigned said Deed of Trust to The Bank of New York Mellon, f/k/a The Bank of New York as successor in interest to JPMorgan Chase Bank, N.A. as Trustee for NovaStar Mortgage Funding Trust, Series 2004-3, NovaStar Home Equity Loan Asset-Backed Certificates, Series 2004-3 via an instrument filed of record on September 24, 2010 in Book 7110 , Page 2866 as Document No. 1270666 in the office of the Clerk of the Hinds County, State of Mississippi; and
WHEREAS, THE BANK OF NEW YORK MELLON, F/K/A THE BANK OF NEW YORK AS SUCCESSOR IN INTEREST TO JPMORGAN CHASE BANK, N.A. AS TRUSTEE FOR NOVASTAR MORTGAGE FUNDING TRUST, SERIES 2004-3, NOVASTAR HOME EQUITY LOAN ASSET-BACKED CERTIFICATES, SERIES 2004-3 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 06/30/2025 and record on 09/11/2025 in Book 7324, Page 8697 as Document No. 1913561 of the records of the Hinds County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said Promissory Note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc, the Substituted Trustee in said Deed of Trust will on 10/10/2025, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the North Front Door, Hinds County Courthouse (1st Judicial District), 407 East Pascagoula Street, Jackson, MS 39201, the following described property located and situated in Hinds County, Mississippi, to wit:
LOT 6, CEDAR PARK SUBDIVISION, PART I, A SUBDIVISION ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND OF RECOD IN THE OFFICE OF THE CHANCERY CLERK OF HINDS COUNTY AT JACKSON, MISSISSIPPI, IN PLAT BOOK 20 PAGE 10, REFERENCE TO WHICH MAP OR PLAT IS HEREBY MADE IN AID OF AND AS A PART OF THIS DESCRIPTION.
More commonly known as: 5360 KEELE STREET, JACKSON, MS 39206
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
