NOTICE OF DEFAULT AND FORECLOSURE SALE WHEREAS, on April 09, 2007, a certain mortgage was executed by Carlee Holmes Sr. as mortgagor in favor of Vertical Lend Inc. as mortgagee and was recorded with the Clerk of Gloucester County in Mortgage Book MB Volume 10516 Page 167 or Document#23616 (“Mortgage”); and WHEREAS, the Mortgage encumbers property located at 738 Wick Boulevard Woodbury, NJ 08096 Block 164.06 FKA 164F; Lot 1 (“Property”); and WHEREAS, entirety and sole owner of the mortgaged premises and being foreclosed herein by plaintiff. Carlee Holmes, Jr. died intestate on March 8, 2023, a resident of the Township of Woodbury, County of Gloucester and State of New Jersey. Melissa Holmes-Tuten qualified as Melissa Holmes-Tuten of the Estate of said decedent by way of a Complaint for Administration filed in the Gloucester County Surrogate’s Office on May 17, 2023, bearing Docket Number #23-00913. Letters of Administration were issued on August 28, 2023, disclosing the following heirs at law and next of kin of decedent: Melissa Holmes-Tuten, Individually and as Administratrix of the Estate of Carlee Holmes, Sr. is hereby a party defendant to this foreclosure action. Carlee Holmes, Jr. is made party defendants to this foreclosure action for any lien, claim or interest they may have in, to or against the mortgaged premises since they are the heirs and next of kin of decedent, Carlee Holmes, Sr. Defendant(s), Melissa Holmes-Tuten, has an ownership interest in the mortgaged premises as a result of the death of Carlee Holmes, Sr. In the event Melissa Holmes-Tuten is married, plaintiff herein joins Mr. or Mrs. Holmes-Tuten, husband or wife of Melissa Holmes-Tuten, the spouse, domestic partner or civil union partner of Melissa Holmes-Tuten, for any interest whatsoever he/she may have acquired in the mortgaged premises, including but not limited to any possessory or dower/curtesy interest he/she may hold in the premises as the spouse of defendant, Melissa Holmes-Tuten, although their name is not known at this time. Defendant, Melissa Holmes-Tutenis the heir of decedent and property owner Carlee Holmes, Sr. Defendant(s), Carlee Holmes, Jr., has an ownership interest in the mortgaged premises as a result of the death of Carlee Holmes, Sr. In the event Carlee Holmes, Jr. is married, plaintiff herein joins Mr. or Mrs. Holmes-Tuten, husband or wife of Carlee Holmes, Jr., the spouse, domestic partner or civil union partner of Carlee Holmes, Jr., for any interest whatsoever he/she may have acquired in the mortgaged premises, including but not limited to any possessory or dower/curtesy interest he/she may hold in the premises as the spouse of defendant, Carlee Holmes, Jr., although their name is not known at this time. Defendant, Carlee Holmes, Jr. is the heir of decedent and property owner Carlee Holmes, Sr. The State of New Jersey is made a party defendant to this foreclosure action for any state inheritance taxes and/or estate taxes which may be due to the State of New Jersey and which may be a lien against the mortgaged premises by reason of the death of Carlee Holmes, Sr., record owner of the mortgaged premises who passed away on March 8, 2023, a resident of the Township of Woodbury, County of Gloucester and State of New Jersey. If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder's deposit will be forfeited, and the Commissioner may, at the direction of the HUD Field Office Representative, offer the Property to the second highest bidder for an amount equal to the highest price offered by that bidder. There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act.
