The approximate upset sum is $1,468,942.84 calculated through August 27, 2025 plus any additional advance, interest, Sheriff's cost and commission to the date of sale.
Unit 316, situated in One Hudson Park, a Condominium, together with an undivded 0.7199% percent interest in the Common Elements of said Condominium referred to in this Deed as the "Condominium Unit") and the right to use Assigned Parking Space #134 and Designated Parking Space #150. The conveyance evidenced by this Deed is made under the provisions of and is subject to the New Jersey Condominium Act (N.J.S.A. 46:8B-1 et seq.) and the Planned Real Estate Development Full Disclosure Act (N.J.S.A. 45:22A-21 et seq.) as amended, and any applicable regulations adopted under either law. The conveyance evidenced by this Deed is also made in accordance with and subject to the covenants, restrictions, conditions, easements, charges, assessments, obligations, liens and other provisions set forth in The Master Deed for One Hudson Park, a Condominium dated April 20, 2007 and recorded in the Office of the Clerk of Bergen County on April 26, 2007 in Book 09301 at Page 112, as teh same may now or hereafter be lawfully amended, and all exhibits and amendments thereto, including all easements, terms, conditiong, reservations, rights-of-way, air rights and covenants of record now or hereafter granted thereunder, and all governmental statues, ordinances and regulations, possible added assessments for the year of sale as set or levied under N.J.S.A. 54:4-53 1, et seq. and all facts that an accurate survey may disclose.
The sale is subject to any unpaid taxes and assessments, tax, water and sewer liens and other municipal assessments. The amount due can be obtained from the local taxing authority. Pursuant to NJSA 46:8B-21 the sale may also be subject to the limited lien priority of any condominium/home-owner association liens which may exist. The sale may be further subject to Restrictions, reversions, reservations, and easements of record.
Surplus Money: If after the sale and satisfaction of the mortgage debt, including costs and expenses, there remains any surplus money, the money will be deposited into the Superior Court Trust Fund and any person claiming the surplus, or any part thereof, may file a motion pursuant to the Court Rules 4:64-3 and 4:57-2 stating the nature and extent of that person's claim and asking for an order directing payment of the surplus money. The Sheriff or other person conducting the sale will have information regarding the surplus, if any.
Together with all and singular the rights, liberties, privileges, hereditaments and appurtenances thereunto belonging or in anywise appertaining and the reversion and remainders, rents, issues and profits thereof, and also all the estate, right, title, interest, use, property, claim and demand of the said defendants of, in, to and out of the same, be sold to pay and satisfy in the first place unto the said plaintiff the sum of $1,089,188.88 plus interest thereon; 20% of the purchase price in the form of certified Check or Cash is required at time of sale. The property shall be sold subject to all liens and encumbrances of record and the Sheriff makes no representations expressed or implied, as to the existence, amount, or validity of any liens and encumbrances on the property which is the subject matter of this sale. This notice is further subject to Conditions of Sale as set forth by the Sheriff of Bergen County and is subject to the terms and conditions of the Foreclosure Fairness Act.
