PUBLIC NOTICE
NOTICE IS HEREBY GIVEN THAT THE Tobyhanna Township Zoning Hearing Board will conduct a public hearing at the Tobyhanna Township Municipal Building, 105 Government Center Way, Pocono Pines, PA 18350, on Wednesday, October 8, 2025 at 5:00 p.m. for the purpose of hearing the following:
APPLICANTS JBPHL Investments, LLC of 15 W. Hillcrest Avenue, Havertown, PA 19083. Applicant filed an amended application on September 9, 2025 challenging the substantive validity of the Tobyhanna Township Zoning Ordinance pursuant to §916.1(a)(1) of the Pennsylvania Municipalities Planning Code (“MPC”). Applicant owns 232 Old Route 940, Pocono Lake, consisting of seven (7) Tobyhanna Township tax parcels described as follows: 19.9.2.53; 15.9.2.53-10; 19.9.2.53-14T; 19.9.2.53-20; 19.9.2.53-11; 19.9.2.53-8T and 19.9.2.53-10T.
Applicant proposes to develop commercial self-storage facilities on these collective parcels of land. Applicant alleges the Tobyhanna Township Zoning Ordinance does not permit commercial self-storage facilities to be located in any zoning district or on any property within the Township. Applicant alleges the Zoning Ordinance is both de jure and de facto exclusionary as to commercial self-storage facilities, is invalid and unconstitutional under Pennsylvania law. The properties in question are zoned R-1.
Any interested party may examine the plans and applications for this public notice during the hours of 8:30 A.M. to 4:00 P.M. at the Tobyhanna Township Municipal Building on business days.
