REQUEST FOR PROPOSALS/QUALIFICATIONS
CONSTRUCTION OF NEW COUNTY JAIL
OWEN COUNTY, INDIANA
I. PROJECT INTRODUCTION:
In accordance with I.C. 5-23-5, the Board of Commissioners of the County of Owen (the “Board”), which serves as the legislative and executive body of Owen County, Indiana (the “County”), invites any and all qualified parties to submit Proposals and Statements of Qualifications to develop and construct a new jail within the County (the “Project”) under a public-private partnership. The purpose of this Request for Proposals/Qualifications (the “RFPQ”) is to identify qualified developers/contractors capable of scoping, developing, and constructing a new jail for use by the County.
II. PROJECT SCOPE:
The County is the owner of certain real property located at 947 W. State Road 46, Spencer, Indiana 47460 and being further identified by Parcel Number: 60-10-19-100-080.001-027, consisting of 9.5 acres more or less (the “Project Site”). The Project Site sits on vacant land that was formerly used as a quarry.
The selected proposer will provide all development services, site work, labor, and materials to develop and construct the Project. The County previously contracted with a third party to design the Project. Therefore, design services are not included within the scope of this Project.
The final Project scope will be determined through a scoping period with the selected offeror, during which the selected offeror will be required to provide financing terms, analysis of the Project to create a final scope, site analysis, and a guaranteed budget. Time will be of the essence with regard to the scoping period.
Upon receiving satisfactory scoping period deliverables from the selected proposer, the Board will move forward with the Project and selected proposer via resolution or ordinance at a public hearing to complete the Project’s construction and development. If (1) the selected proposer is unable to produce a satisfactory proposal or scoping period deliverables, or (2) the Board determines that the Project is not necessary or wise, then the Board will reject the proposers’ proposal or cancel this RFPQ process altogether. In either event, the resulting scoping period deliverables will be solely owned by the County, and the County may use the information from the scoping period deliverables for its future use and benefit.
III. PROPOSAL EVALUATION:
The Board will review the proposals received in response hereto. The criteria which will be utilized in evaluating proposals are as follows:
• Experience developing similar projects.
• Demonstrated ability and capacity to perform the work, including your reputation as supported
by references for work previously performed.
• Familiarity with Project Site.
• Approach to develop the Project.
• Terms of proposed financing.
• Proposed fees during scoping period.
IV. PROPOSALS
Please respond to the following requests:
• A description of the Project team, including the Project lead and the construction team.
• Identify at least three (3) similar projects you have developed and constructed. Include names, addresses, and telephone numbers to be used as references relative to the listed projects.
• A proposed schedule for the Project, including proposed dates to start and complete construction and information on phasing of the Project.
• Set forth the proposed financing strategy.
• Identify fees that may be requested during the scoping process. Hourly rates, an overall lump sum, or multiple lump sums segregated by task may be proposed.
V. General Conditions
It should be understood that:
• The Board reserves the right to reject any and all Proposals/Statements of Qualifications at its sole discretion. The Board may select more than one offeror or no offerors at all.
• The Board does not require you to submit a certified check or other evidence of financial responsibility with your proposal other than the description of financing approach requested above.
• The stated scoping period fee will be a critical component in reviewing proposals.
• All proposers will be accorded fair and equal treatment with respect to any opportunity for discussion and revision of proposals. The Board may enter into discussions with proposers to clarify and assure a full understanding of proposals.
• The Board may refuse to disclose the contents of the Proposals/Statement of Qualifications during discussions with eligible proposers.
• The successful proposer will be required to post a payment bond and performance bond pursuant to the provisions of I.C. 5-23-3-2.
• The successful proposer will be required to comply at all times with the provisions of I.C. 5-23 et seq.
• The construction of any infrastructure or buildings procured via this solicitation will be financed in partnership with the selected proposer under I.C. 5-23, and therefore the Project will not utilize “public funds” as defined in I.C. § 5-22-2-23. Per both statutes, the selected proposer will not be subject to further procurement processes under I.C. 36-1-12 or any other statute.
• Proposing firms shall not contact County Council members or any other elected or appointed public officials upon release of this RFPQ other than the Board’s representative (the “Representative”) listed below, unless authorized or directed to do so by the Representative. • The Board reserves the right to enter into a Scoping Agreement with a proposer for preliminary development services prior to the Board agreeing to move forward with the Project. After the scoping period, the Board shall either make a recommendation to award the public-private agreement to a proposer (or proposers), or shall terminate the process altogether.
