FINAL JUDGMENT ORDER
THIS MATTER having come before the court by way of motion filed by Rebecca D. Boudwin, Esquire, of Boudwin Ross Roy Leodori PC, on behalf of Plaintiff for an order entering Final Judgment; and
WHEREAS this matter concerns the foreclosure of Tax Sale Certificate # 16-00034 ("Certificate") which was subsequently assigned to Joseph H. Lawrence, Jr., dated February 18, 2016; and the Certificate concerns the real property at Block 1702, Lot 13 commonly known as Ongs Hat Road, Southampton, New Jersey ("Property"); and the Certificate was recorded with the Burlington County Clerk on April 7, 2016 in Mortgage Book OR13216 at Page 7850, et seq.; and
WHEREAS according to the Affidavit of Melissa J. Chesla ("Ms. Chesla"), the Tax Collector of the Township of Southampton, Burlington County, New Jersey, that Ms. Chesla attended her office at 5 Retreat Road, Southampton, New Jersey on the 5th day of August 2025, during normal business hours; and had in her possession the Certificate which affects Block 1702, Lot 13, on the tax duplicate of the Township of Southampton, Burlington County, New Jersey; and upon which there is due as of June 2, 2025, the sum of $3,764.66; and the Certificate is ready for cancellation in accordance with the terms of the Order setting time, place, and amount of redemption entered into on June 6, 2025; and
WHEREAS the Certification in Support of Motion for Final Judgment duly filed herein that the notice of redemption was both personally served and duly mailed by certified mail, return receipt requested, and by regular mail, in accordance with the terms of the Order of the Court concerning the Defendants whose address is known, and published in the Burlington County Times for Defendants whose addresses are unknown; and
WHEREAS it further appearing that default has been entered by the Clerk of the Court against Defendants; and the Plaintiff has made an investigation but is unable to determine whether the defaulting Defendants, Frank H. Doglione, his heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; Elizabeth Ann Doglione, her heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; George Sooy, his heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; and Rachel L. Sooy, her heirs, devisees and personal representatives, and their or any of their successors in right, title and interest, are in the military service and good reason appearing that the judgment applied for should be granted at this time and that the judgment should be entered without the filing of a Servicemembers Civil Relief Act bond; and
WHEREAS further that neither the Defendants, nor any person or person acting on their behalf, appeared before her at the time and place aforesaid; that neither the Defendants, nor any person or persons acting in their behalf paid or offered to pay the Plaintiff the sum of money of $3,764.66 to be due to the Plaintiff, at the time and place aforesaid; and that the said sum and said costs still remain due and owing to Plaintiff; and
WHEREAS this matter was brought by Plaintiff pursuant to the provisions of the Tax Sale Law codified at N.J.S.A. 54:5-1 et seq.; and the holder of a tax sale certificate has the right to receipt of the amount paid for the certificate together with interest at the redemption rate; and if the delinquent owner fails to redeem the certificate within two years of the date of sale, the holder has the right to acquire title by foreclosure; and an owner has the right to redeem at any time up to the entry of final judgment. Simon v. Cronecker, 189 N.J. 304, 319 (2007); and
WHEREAS in response to the decision in Tyler v. Hennepin County, 598 U.S. 631 (2023), the New Jersey Supreme Court issued an order on July 10, 2023 providing in part that in accordance with Rule 4:64-1 (d) "the plaintiff in a tax foreclosure complaint must personally serve any and all parties having the right of redemption with all prejudgment notices, including the notice motion for entry of judgement"; and Plaintiff has provided evidence of these notices; and
WHEREAS the court having considered the paper filings; and it appearing that the Notice of Motion for Final Judgment, Certification in Support, Proposed Final Judgment, and Certification of Mailing were duly issued to all defendants; and no opposition having been filed; and for good cause shown;
IT IS on this 23rd day of September 2025 ORDERED AS FOLLOW:
1. Defendants Frank H. Doglione, his heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; Elizabeth Ann Doglione, her heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; George Sooy, his heirs, devisees and personal representatives, and there or any of their successors in right, title and interest; and Rachel L. Sooy, her heirs, devisees and personal representatives, and their or any of their successors in right, title and interest, stand absolutely debarred and foreclosed of and from any and all right, and equity of redemption, in and to the lands and every part thereof, which lands and premises are more particularly described as follows: ALL THAT CERTAIN tract or parcel of land and premises, situate in the Township of Southampton, County of Burlington and State of New Jersey, as follows: BEING Block 1702, Lot 13 on the tax map of Township of Southampton, COMMONLY known as Ongs Hat Road, Southampton, New Jersey.
2. Plaintiff, Joseph H. Lawrence, Jr., whose address is 1 Simontown Road, Pemberton, New Jersey, is vested with an absolute and indefeasible estate of inheritance in fee simple to the premises above described.
3. Plaintiff, Joseph H. Lawrence, Jr., duly recovers against the Defendants, Frank H. Doglione, his heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; Elizabeth Ann Doglione, her heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; George Sooy, his heirs, devisees and personal representatives, and their or any of their successors in right, title and interest; and Rachel L. Sooy, her heirs, devisees and personal representatives, and their or any of their successors in right, title and interest, the possession of said lands and premises described and mentioned in the Complaint and in this judgment.
4. NOT WITHSTANDING anything herein to the contrary, this judgment shall not affect the rights of any person protected by the New Jersey Tenant Anti-Eviction Act, N.J.S.A. 2A:18- 61.1, et seq., the right of redemption given the United States under 28 U.S.C. §2410, the limited priority rights for the aggregate customary condominium assessment for the six-month period prior to the recording of any association lien as allowed by N.J.S.A. 45:8B-21 or rights afforded by the Servicemembers Civil Relief Act, 50 U.S.C. App. 501 et seq. or N.J.S.A. 38:23C-4.
IT IS FURTHER ORDERED that service of this Final Judgment shall be deemed effectuated upon its upload to eCourts. Movant shall serve all parties not electronically served within seven (7) days of receipt of this signed Order.
