JOSE L. HERNANDEZ AND ESTELA A. MARTINEZ, husband and wife, as community property with right of survivorship; MORTGAGE ALLIANCE FINANCIAL NETWORK, LLC FKA MORTGAGE ALLIANCE OF ARIZONA; REGIONAL ACCEPTANCE CORP; THE UNKNOWN HEIRS AND DEVISEES OF JOSE L. HERNANDEZ AND ESTELA A. MARTINEZ, IF DECEASED, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 24th day of July, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 23th day of April, 2020, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendants, above-named, as follows:
Amounts awarded in judgment, accruing interest at rate stated in judgment UD3 -- $13,271.46; Pre-judgment interest -- $166.26; 2021-2025 assessments -- $4,464.00; Interest accrued on judgment through July 16, 2025 -- $388.96; Supplemental attorney fees and costs pending Court approval -- $5,379.60; Less credits or payments applied -- ($15,012.33); Total judgment balance as of July 16, 2025 -- $8,657.95.
Interest will continue to accrue at the rate of $0.00 per diem from July 17, 2025, plus monthly late charges commencing July 2025. Additional assessments will accrue January 1, 2026, in an amount not less than $900.00, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot 24, Miller Manor Phase 1, according to Book 771 of Maps, Page 46 and Certificate of Correction recorded in Document No. 2006-0329790, records of Maricopa County, Arizona.
AKA: 5803 South 249th Lane, Buckeye, Arizona 85326.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 16th day of October, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
