MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Timothy J. Fitzgerald and Sheryl L. Gravning-Fitzgerald to New Century Mortgage Corporation, dated August 25, 2005 and recorded with the Plymouth County Registry of Deeds at Book 31236, Page 308, subsequently assigned to DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR NEW CENTURY HOME EQUITY LOAN TRUST, SERIES 2005-D, ASSET BACKED PASS-THROUGH CERTIFICATES by NEW CENTURY MORTGAGE CORPORATION by assignment recorded in said Plymouth County Registry of Deeds at Book 44182, Page 36 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on October 16, 2025 at 84 Booth Hill Road, Scituate, MA, all and singular the premises described in said Mortgage, to wit:
A certain parcel of land, with the buildings thereon situated on the northwesterly side of Booth Hill Road, formerly Blossom Street, in Scituate, Plymouth County, Massachusetts, shown on a plan entitled, Plan of Land on Booth Hill Road Scituate, dated November 29, 1968, by Loring H. Jacobs, recorded with Plymouth Deeds as Plan No. 13 of 1969, Plan Book 14, Page 1182, bounded and described as follows:
SOUTHEASTERLY by Booth Hill Road by two lines measuring respectively, one hundred forty-six and 45/100 (146.45) feet and fifty-eight and 27/100 (58.27) feet;
SOUTHWESTERLY by land now or formerly of Sullivan, one hundred sixteen and 06/100 feet;
SOUTHWESTERLY again by two lines measuring respectively eighty-four and 44/100 (84.44) feet and eighty-one and 36/100 (81.36) feet;
EASTERLY by several lines, together measuring one hundred forty-one and 35/100 (141.35) feet;
SOUTHEASTERLY one hundred twenty-three and 40/100 (123.40) feet;
EASTERLY by two lines measuring respectively eighty-five and 40/100 (85.40) feet and one hundred thirty-two and 50/100 (132.50) feet, all of the foregoing courses being by land now or formerly of Stitt;
SOUTHERLY by land now or formerly of Macintosh by three lines measuring respectively one hundred seventeen and 62/100 (117.62) feet, seventy- six and 01/100 (76.01) feet and twenty-two and 02/100 (22.202) feet;
WESTERLY by land now or formerly of Scituate Rod and Gun Club by two lines measuring respectively three hundred ninety-six and 64/100 (396.64) feet and two hundred eighty-six and 39/100 (286.39) feet; and
NORTHERLY by the same, three hundred ninety-two and 42/100 (293.42) feet and by lands now or formerly of Iri Voniderstein and of Merritt, three hundred seventy seven and 76/100 (377.76) feet.
Containing 281,011 square feet or 6.45 acres, according to said plan.
Said premises are conveyed subject to and together with the benefit of easements, restrictions and agreements of record, if any, insofar as same are now in force and effect.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
