NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 643 Edgell Road, Framingham, MA 01701
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Brian Cox and Jessica Cox to NE Moves Mortgage, LLC, and now held by CitiMortgage, Inc., said mortgage dated March 15, 2006 and recorded in the Middlesex County (Southern District) Registry of Deeds in Book 47111, Page 487, as affected by a Subordination Agreement dated July 29, 2015 and recorded in said Registry in Book 65906, Page 20, said mortgage was assigned from NE Moves Mortgage, LLC to CitiMortgage, Inc. by assignment dated March 15, 2006 and recorded with said Registry of Deeds in Book 47111, Page 503; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on October 23, 2025 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land at 643 Edgell Road, Framingham, Middlesex County, Massachusetts being shown as Lot 2A on a plan entitled, "Plan of Land in Framingham, Mass.", dated February 27, 1970, by Ewald & Maschi, Inc. , Eng . Consultants, Petioner: Edgell Homes Inc., recorded with Middlesex South District Registry of Deeds, Book 11928, Page End.
SAID PREMISES ARE SUBJECT TO THE FOLLOWING ENCUMBRANCES:
1. Rights of others in the forty (40) foot wide utility and driveway easement shown on the above referenced plan and more specifically set forth in a Deed from Boston J. Moran, et al, dated January 7, 1971, recorded with said Deeds, Book 11941, Page 723.
2. Rights of the owners and or occupants of Lots 1 and 3A shown on said Plan to connect with the water and sewer pipe lines and utility lines shown on said Plan, more specifically set forth in a Deed from Boston J. Moran, et al, dated January 7, 1971, recorded with said Deeds, Book 11941, Page 723.
3. Order of Taking by the Massachusetts Water Resources Authority, dated March 6, 1996, recorded with said Deeds, Book 26116, Page 583.
4. Mortgage from Brian Cox and Jessica Cox to NE Moves Mortgage, LLC, dated _________ 2006, recorded with said Deeds on ____________2006, as Instrument No. _________ in the original principal amount of $_________________.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated March 15, 2006 and recorded in the Middlesex County (Southern District) Registry of Deeds in Book 47111, Page 468.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
Said mortgage is subject to a certain mortgage given by Brian Cox and Jessica Cox to Mortgage Electronic Registration Systems, Inc., as nominee for Citibank, N.A., dated 08/05/2015 and recorded in Middlesex County (Southern District) Registry of Deeds in Book 65906, Page 1.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
