MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Frank J. Cuccinello and Heather M. Cuccinello to Option One Mortgage Corporation, dated November 23, 2005 and recorded in Norfolk County Registry of Deeds in Book 23170, Page 127 (the “Mortgage”) of which mortgage Deutsche Bank National Trust Company, as Trustee for HSI Asset Securitization Corporation Trust 2006 OPT4, Mortgage-Pass-Through Certificates, Series 2006-OPT4 is the present holder by Assignment from Sand Canyon Corporation F/K/A Option One Mortgage Corporation to Deutsche Bank National Trust Company, as Trustee for HSI Asset Securitization Corporation Trust 2006 OPT4, Mortgage-Pass-Through Certificates, Series 2006-OPT4 dated October 23, 2012 and recorded at said Registry of Deeds in Book 30789, Page 343, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 14 Heritage Path, Millis, MA 02054 will be sold at a Public Auction at 12:00 PM on October 17, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain tract or parcel of land situated on Heritage Path in Millis, Norfolk County, Massachusetts being shown as Lot 14 on a plan of land entitled "Definitive Subdivision Plan of Village Green, Millis, Massachusetts" dated September 28, 1994 revised through January 30, 1995 prepared by Engineering, Surveying and Planning Associates, 89 Main Street, Suite 203, Medway, MA, which plan is recorded with the Norfolk Registry of Deeds as Plan 237 of 1995 in Plan Book 429 ("Plan") and to which Plan reference may be made for a more particular description of said Lot 14. Said Lot 14 contains an area of 11,282 square feet, more or less according to said Plan.
Said Lot 14 is conveyed subject to the following:
(1) A Covenant entitled "Village Green Covenant" recorded in said Deeds at Book 10869, Page 12 as affected by the release recorded in said Deeds at Book 11024, Page 43; (2) Comprehensive Permit recorded in said Deeds at Book 10869, Page 16; (3) Agreement for Private Ownership and Maintenance recorded in said Deeds at Book 10869, Page 61; (4) Regulatory Agreement and Declaration of Restrictive Covenants recorded in said Deeds at Book 10869, Page 32; (5) Easements and Restrictions of record, and easements and rights of ways as shown on Plan above referenced; (6) Easement Agreement recorded in said Deeds at Book 11042, Page 21; (7) Declaration of Property Restrictions for Subdivision recorded in said Deeds at Book 11042, Page 24; (8)Subject to and with the benefits of the terms and provisions of the Village Green Homeowners Trust recorded in said Deeds at Book 11042, Page 29; (9) Access and Utility Easement and Covenant recorded in said Deeds as Instrument No. 30587 and Trust recorded in said Deeds as Instrument No. 30588; and (10) Order of Conditions recorded in said Deeds at Book 1078, Page 376.
Conveyance is made together with the non-exclusive right to use the following:
Sewer Easement and Drainage Easement as recited in deeds recorded with the Norfolk District Registry of Deeds at Book 4809, Page 376 and Page 379.
Easement for the purpose of a public way, together with the attendant customary uses as recited in deed recorded in said Deeds at Book 16423, Page 64.
Right of Way as recited in a deed recorded in said Deeds at Book 10869, Page 6.
Easement to Boston Edison Company recorded in said Deeds at Book 10954, Page 402.
For mortgagor’s title see deed recorded with the Norfolk County Registry of Deeds in Book 17465, Page 240.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
