MBTA HOUSING ACT
LEGAL NOTICE
Notice is hereby given pursuant to Massachusetts General Laws Chapter 40A, Section 5 (The Zoning Act), that the Planning Board of the Town of Hanover will hold a Public Hearing on Monday, October 20, 2025 at 7:00 p.m. This meeting is to discuss the MBTA Housing Act. Residents are encourage to attend to offer opinions. The Planning Board will participate in this meeting at Hanover Town Hall and also via Zoom video call. The purpose of the Public Hearing is to hear testimony and comment from interested persons relative to proposed amendments to the Zoning Bylaw for the Town of Hanover, said amendments having been submitted to the Select Board for inclusion as Articles on the Warrant for consideration and action at the Special Town Meeting to be convened at the Hanover High School on Monday, December 8, 2025 at 7:00 p.m. After the Public Hearing the Board will, as required by law, vote its recommendations on the proposed articles and report them to the Town Meeting.
The following Proposed Articles for the Special Town Meeting amend the existing Zoning Bylaw as to zoning and planning. These are only summaries and may not be the same as those on the final Special Town Meeting Warrant and are inserted herein for convenience and discussion purposes only.
Summary of Proposed Zoning Articles:
Proposed Article:To see if the Town will amend the Zoning Bylaws relative to adopting an MBTA Overlay District, and zoning provisions to allow as of right multi-family housing in the District.
Proposed Article: To see if the Town will amend the Zoning Bylaw-Sec.10.0 Purpose and Applicability in the development in the Multi-Family Overlay district in accordance with the provisions of Section 6.17.0 of this Zoning Bylaw.
Proposed Article: The Districts Map outlines the area designated to allow multi-family housing as of right. The district meets compliance model requirements established by The Executive Office of housing and Livable Communities EOHLC (formally the DHCD). The current Town of Hanover Zoning Map must be updated to include the new MBTA Zoning District.
