The Penndel Borough Zoning Hearing Board will hold public hearings on Wednesday, October 15, 2025, at 7:00 P.M. at the Borough Building, 300 Bellevue Avenue, Penndel, PA, to consider the following applications: 2025-04, filed by Terry & Meg McIntyre for property located at 335 Hulmeville Ave., in the R-2 Zoning District. The Applicants are requesting variances from: Section 405-20, District regulations in effect; 405 Attachment 1, Table of Dimensional Requirements; and Section 405-23, Front yard regulations, to allow a 32’-0 ½” front yard and to allow an impervious surface ratio of 35.8%. 2025-3, filed by Community Options, Inc. for property located at 566 Bellevue Avenue in the R-1 Zoning District. The Applicant is appealing an 8/15/25 Zoning Violation Notice (“Notice”) and the determination that it is not making a single-family residential dwelling use of the property. The Notice states that the Applicant is operating a personal care type facility with employees and a personal care facility is not permitted in the R-1 District. The Notice further revoked the certificate of occupancy. The Applicant states that the use of the property as a home for residents with developmental and other disabilities is federally protected by the Fair Housing Act and Fair Housing Amendments.
