BOARD OF ADJUSTMENT
TAKE NOTICE that on the 21st day of October, 2025, a hearing will be held at 6:00pm before the Borough of Rutherford Board of Adjustment for the appeal or application of the undersigned Mayank Sinha and Prachi Pandey to subdivide the existing lot (104.41 feet by 100 feet) into two lots, proposed lot one would be 54.41 feet by 100 feet and proposed lot two would be 50 feet by 100 feet which property is located at 124 Fairview Avenue, and designated as Block 49, Lots 1 & 2 on the Borough of Rutherford Tax Map. The property is located in the R-1 (Residential Single Family) Zone. There is an existing one family dwelling which will remain on proposed lot one and a new one family dwelling will be constructed on the new proposed subdivided lot. The proposed one family dwelling will be built within the building envelope and comply with the zoning requirements. Applicant seeks a "C" variance for minimum side yard setback for proposed lot one (5ft/15ft required and 5ft/10.14 ft proposed,) maximum building coverage for proposed lot one (30% required and 33.6% proposed), maximum impervious coverage (25% required and 52% and 23.2% proposed) and a D (6) variance for maximum building height for existing one family dwelling and any other relief as the Board deems just and necessary for the
premises.
The Board of Adjustment will hear this appeal at 6:00pm on October 21, 2025, the second floor of Borough Hall, 176 Park Avenue, Rutherford, New Jersey. Members of the public may appear and present any objection or evidence relating to this appeal. Documents relating to this application may be viewed at Borough Hall by appointment.
