PUBLIC NOTICE
BOROUGH OF HARVEY CEDARS
Public notice is hereby given that Peter Gadaleta and Jeannette Gadaleta (collectively the "Applicant") have applied to the Land Use Board of the Borough of Harvey Cedars (the "Board"), Ocean County, New Jersey for variances from Borough Ordinances relative to proposed development on the property designated as Lot 10 in Block 78 on the Tax Map of the Borough of Harvey Cedars, located at 8604 Driftwood Avenue. The property is currently developed with a two-story single-dwelling raised on pilings, with a partial enclosed area below. The Applicant proposes to construct a first and second-story addition along the easterly side of the existing dwelling. The existing storage enclosure below would also be expanded to the east. There is also an elevator addition proposed along the westerly side of the dwelling. The following variances are requested from the Harvey Cedars Zoning Ordinance:
Section 13-9.4(b)(1): Every lot in the R-A District shall have a minimum front yard setback of 20 feet. The existing front yard setback is 23.5 feet; the proposed front yard setback is 12 feet.
Section 13-9.4(b)(3): Every lot in the R-A District shall have two side yards, each with a minimum distance of 10 feet. The existing northerly side yard setback is 9.1 feet; the proposed northerly side yard setback is 8.22 feet.
Section 13-7.2(c): No building or structure shall exceed a maximum sloped-roof height of thirty-two (32) feet. When existing setbacks do not meet or exceed the required setbacks of the district, the height shall not exceed thirty (30) feet. A flat-roofed building with a pitch less than one in twelve, or other structure, shall not exceed twenty-eight (28) feet (26 feet when existing setbacks do not meet the required setbacks of the district). Deck railings shall not exceed thirty-one (31) feet in height (29 feet when existing setbacks do not meet the required setbacks of the district).
Due to the nonconforming northerly side yard setback, the maximum permitted height of flat roofs is 26 feet. The existing height of the roof deck on the easterly side of the dwelling is 26.79 feet. The proposed height of the altered roof deck on the easterly side of the dwelling is 26.79 feet.
Due to the nonconforming northerly side yard setback, the maximum permitted height of the roof deck railings is 29 feet. The existing height of the roof deck railings is 30 feet. The proposed height of the altered roof deck railings is 30 feet.
If the Land Use Board determines that any other variances, exceptions or waivers are necessary or appropriate at the hearing, then such variances, waivers or exceptions will be requested.
A public hearing has been scheduled for October 16, 2025 at 7:00 p.m. in the Harvey Cedars Municipal Building, 7606 Long Beach Boulevard, Harvey Cedars, New Jersey, at which time any interested persons may appear and have an opportunity to be heard on this application.
Documents pertaining to this application are available for inspection by the public during normal business hours Monday through Friday in the office of the Land Use Board at the Harvey Cedars Municipal Building.
