EXECUTION AND ORDER OF SALE

DISCOVERY AT VILLA DE PAZ HOMEOWNERS’ ASSOCIATION, an Arizona non-profit corporation, Plaintiff(s),
vs.
KURT OLESON, a single man, record owner; and
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 22nd day of July, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 12th day of February, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, as follows:
A total principal balance of $5,926.08 through January 8, 2025, plus accruing assessments in an amount not less than $288.48 per month commencing February 1, 2025, along with late fees of $15.00 per month, plus costs taxed and allowed in the amount of $893.62, attorney’s fees in the amount of $2,316.00, and accruing interest at the rate of 8.75% per annum on the amounts awarded in the Judgment. Interest of $298.80 has accrued on the Judgment to date; In addition, on June 5, 2025, Plaintiff was granted post-judgment attorney’s fees in the amount of $1,848.00 and post-judgment costs in the amount of $548.31.
THEREFORE, the amounts awarded, plus all additional assessments, late charges, attorney’s fees, costs, and interest that have accrued thereafter through the date of this Writ, as awarded in terms of the above-referenced Judgment, total a current balance of $13,348.21, which is now at the date of this Writ due on such Judgment, plus interest at the rate of 8.75% per annum. Additional monthly assessments of $288.48 commencing July 1, 2025, monthly late fees of $15.00, attorney’s fees and costs of the Sheriff’s Sale will continue to accrue and be incurred and are to be added to the current balance as of the date of the Writ and through the date of the Sheriff’s Sale of the Property; plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to wit:
Unit 50, of DISCOVERY AT VILLA DE PAZ, according to the Declaration of Horizontal Property Regime recorded in Document No. 84-021343 and re-recorded in Document No. 84-028293 and re-recorded in Document No. 84-038490 and First Amendment recorded in Document No. 84-091836 and Second Amendment recorded in Document No. 84-170924 and Annexations thereto recorded in Document No. 84-028360 through Document No. 84-028372 inclusive and Amendments recorded in Document No. 84-091387 through Document No. 84-091849, inclusive and Re-recorded in Document No. 84-198262 through Document No. 84-198273, inclusive, and Declaration or Annexation recorded in Document No. 84-180083 and Assignment of Declaration Rights recorded in Document No. 85-266394 and according Map recorded in Book 261 of Maps, page 21 and Affidavit of Correction recorded in Document No. 84-069169 and in Document No. 84-146798, records of Maricopa County, Arizona;
TOGETHER WITH a proportionate interest in and to the common areas as set forth in said Declaration of Horizontal Property Regime as shown on said Plat.

NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 23rd day of October, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
