vs.
RICARDO AGUAYO VALENZUELA, an unmarried man, record owner; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, Inc. solely as nominee for Geneva Financial, LLC; SECRETARY OF HOUSING AND URBAN DEVELOPMENT; UNKNOWN HEIRS AND DEVISEES OF EACH OF THE NAMED DEFENDANT IF DECEASED, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 22nd day of July, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 4th day of March, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, as follows:
A total principal balance of $3,318.62 through January 28, 2025, plus accruing quarterly assessments in an amount not less than $253.00 per quarter commencing April 1, 2025, along with late fees of $15.00 per quarter, plus costs taxed and allowed in the amount of $863.06, attorney’s fees in the amount of $2,300.00, and accruing interest at the rate of 8.50% per annum on the amounts awarded in the Judgment. Interest of $143.04 has accrued on the Judgment to date; In addition, on May 13, 2025, Plaintiff was granted post-judgment attorney’s fees in the amount of $1,706.00 and post-judgment costs in the amount of $541.43.
THEREFORE, the amounts awarded, plus all additional assessments, late charges, attorney’s fees, costs, and interest that have accrued thereafter through the date of this Writ, as awarded in terms of the above-referenced Judgment, total a current balance of $9,140.15, which is now at the date of this Writ due on such Judgment, plus interest at the rate of 8.50% per annum. Additional quarterly assessments of $253.00 commencing July 1, 2025, quarterly late fees of $15.00, attorney’s fees and costs of the Sheriff’s Sale will continue to accrue and be incurred and are to be added to the current balance as of the date of the Writ and through the date of the Sheriff’s Sale of the Property; plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to wit:
LOT 69, OF COUNTRY PLACE PHASE 2B PARCEL 28/29, ACCORDING TO THE PLAT OF RECORD IN THE OFFICE OF THE COUNTY RECORDER OF MARICOPA COUNTY, ARIZONA, RECORDED IN BOOK 636 OF MAPS, PAGE 34.
AKA: 9550 W. Kingman Street, Tolleson, Arizona 85353.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 23rd day of October, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
