NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 40 Duncan Street, Fall River, MA 02721
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Melissa Tavares and Frank Hobbs to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Pacific Union Financial, LLC, and now held by Freedom Mortgage Corporation, said mortgage dated June 1, 2018 and filed in the Bristol County (Fall River District) Registry District of the Land Court as Document No.: 49841 and noted on Certificate of Title No.: 7771,said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Pacific Union Financial, LLC to Freedom Mortgage Corporation by assignment dated July 25, 2023 and filed with Bristol County (Fall River District) Registry District of the Land Court as Document No.: 54603 and noted on Certificate of Title No.: 7771; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on October 31, 2025 at 10:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
That land with all the buildings and improvements thereon, situated in Fall River, in the County of Bristol and Commonwealth of Massachusetts, bounded and described as follows:
Southerly by Duncan Street, one hundred fifteen (115) feet;
Westerly by land now or formerly of Alfred Dupre, et al, ninety three and 67/100 (93.67) feet;
Northerly by lands now or formerly of Manuel Braga, et al,
and Edward Alves, et al, one hundred fifteen (115) feet; and
Easterly by land now or formerly of Armand R. Auclair, ninety six and 27/100 (96.27) feet.
All of said boundaries are determined.by the Court to be located as shown on a plan drawn by JB Engineering Surveyors, George J. Thomas, Civil Engineer, dated June 22, 1963, as modified and approved by the Court, filed in the Land Registration Office, a copy of a portion of which is filed with Original Certificate of Title #1919, Book 10, Page 379. Fall River District of the Land Court.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated June 1, 2018 and registered with the Bristol County (Fall River District) Registry District of the Land Court as Document No.: 49840 and noted on Certificate of Title No.: 7771.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
