RESOLUTION NO. R2025.105
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPE, ARIZONA, CALLING AND ORDERING A PRIMARY ELECTION TO BE HELD ON MARCH 10, 2026, AND A GENERAL ELECTION, IF NECESSARY, TO BE HELD ON MAY 19, 2026, TO BE CONDUCTED AS BALLOT-BY-MAIL ELECTIONS.
WHEREAS, pursuant to the Tempe City Charter and Arizona Revised Statutes, the City of Tempe’s next regularly scheduled elections will be held on March 10, 2026, and May 19, 2026, for the purpose of nominating and/or electing three members of the City Council; and,
WHEREAS, Article VII of the Tempe City Charter provides that in the event no more than two candidates file nomination petitions for each vacancy in office, the Primary Election may be dispensed with. If no Primary Election is required due to the number of candidates filing nomination petitions for each vacancy in office, the Regular City Election shall be held at the time that the Primary Election would have otherwise been held;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TEMPE, ARIZONA, as follows:
SECTION 1. There is hereby called and ordered to be held in the City of Tempe, Arizona, on Tuesday, March 10, 2026, a Primary Election, and, if necessary, on Tuesday, May 19, 2026, a General Election, for the purpose of nominating and/or electing three (3) Members of the City Council for full four (4)-year terms.
SECTION 2. The March 10, 2026, Primary Election and the May 19, 2026, General Election shall be conducted as ballot-by-mail elections.
SECTION 3. The ballots to be used at the elections shall be in the form and content required by law.
SECTION 4. The City Clerk is authorized and directed to procure all necessary election services, including official ballots, notices, printed matter, supplies, equipment, and any other materials or services required to lawfully conduct the elections.
SECTION 5. Candidate nomination paperwork and information packets are currently available by appointment from the City Clerk at the Tempe City Clerk’s Office, Tempe City Hall, 2nd Floor, 31 E. 5th Street, Tempe, Arizona.
SECTION 6. The first day to file candidate nomination paperwork is Tuesday, October 14, 2025, at 8:00 a.m., in the City Clerk’s Office. The deadline to file candidate nomination paperwork is Monday, November 10, 2025, at 5:00 p.m., in the City Clerk’s Office.
SECTION 7. Pursuant to Section 7.01 of the City Charter, if no more than six (6) candidates file nomination petitions for the three (3) vacant City Council seats and are certified for the ballot, the Primary Election shall be dispensed with, and the General Election shall be held at the time that the Primary Election would have been held, on March 10, 2026.
SECTION 8. Notwithstanding Section 7 of this Resolution, and pursuant to Section 13-4 of the City Code, any candidate receiving a majority of all the votes cast at the Primary Election will be declared elected to office effective as of the date of the General Election, and no further election shall be held for that office.
SECTION 9. Pursuant to Section 2.01 of the City Charter, the term of office for the candidates declared elected to office shall commence at the first regular meeting of the City Council in July following their election and, except as otherwise provided for by the City Charter and State Law, shall be for a period of four (4) years or until their successors are elected and qualified.
SECTION 10. The deadline to register to vote in the March 10, 2026, Primary Election is Monday, February 9, 2026, at 11:59 p.m. The deadline to register to vote in the May 19, 2026, General Election, if necessary, is Monday, April 20, 2026, at 11:59 p.m. (Dates subject to change under State Law.)
SECTION 11. Notice of the time and place of holding the election is given, and the City Clerk is authorized, instructed, and directed to give further or additional notice of the election, in time, form, and manner as required by law.
SECTION 12. In all particulars not recited in this Resolution, the elections shall be held and conducted in accordance with the election laws of the State of Arizona, except as otherwise provided by the City Charter.
