NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Commercial Mortgage, Security Agreement, Assignment of Leases and Rents and Fixture Filing dated August 2, 2023 given by JP Development Properties, LLC to RD W SPV LLC, said mortgage recorded with the Worcester County (Worcester District) Registry of Deeds in Book 69474, Page 117, as affected by that certain Amendment No.1 to Commercial Mortgage, Security Agreement, Assignment of Leases and Rents and Fixture Filing dated January 7, 2025 and recorded with the Worcester County (Worcester District) Registry of Deeds in Book 71509, Page 261 and which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at public auction at 12:00 p.m. on the 28th day of October, 2025 on the premises at 102-104 Central Street Milford, Massachusetts, all and singular the premises described in said mortgage.

A certain parcel of land, including all buildings thereon on the northerly side of Central Street and easterly side of Bragg Street in Milford, Worcester County, Massachusetts, bounded and described as follows:
Beginning at the southwesterly corner of the granted premises at a point where the northerly line of said Central Street intersects the easterly line of Bragg Street; thence
EASTERLY by the northerly side of said Central Street about 42 feet to land now or formerly of one Gillon; thence
NORTHERLY by said Gillon land about 73.26 feet to land now or formerly of one Skinner; thence
WESTERLY by said Skinner land about 42 feet to the easterly line of said Bragg Street; thence
SOUTHERLY by the easterly side of said Bragg Street 77.88 feet to the point of beginning.
Together with the right of way ten (10) feet in width adjoining the easterly side of the above premises; and subject to the right of way ten (10) feet in width over the granted premises parallel and next to the easterly line thereof; meaning to convey and hereby conveying all the same premises conveyed by Eran A. Fisk and Ezra F. Holbrook to Lloyd H. Cook by deed dated July 29, 1881 recorded with the Worcester District Deeds in Book 1101, Page 104 and subject to the reservations therein mentioned; except such part thereof, if any, as was taken by the Town of Milford in laying out of said Bragg Street. Meaning to convey and hereby conveying all the same premises conveyed by Clifford A. Cook to use by deed dated January 29, 1914, recorded with Worcester District Deeds in Book 2071, Page 475.

Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens and rights of any tenants and parties in possession, if there be any, or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. The successful bidder will pay all costs of recording the foreclosure deed and any other foreclosure documents including, without limitation, all state and county excise stamp fees, and shall also be responsible for any Title V inspection and repair requirements.
Terms of sale: A deposit of Twenty-Five Thousand and 00/100 Dollars ($25,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check to Mirrione, Shaughnessy & Uitti, LLC, 2 Batterymarch Park, Suite 202, Quincy, MA 02169 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
