MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Bertha Alexander and Lawrence Alexander to Fleet National Bank, dated November 18, 2002 and recorded in Norfolk County Registry of Deeds in Book 18181, Page 457 (the “Mortgage”), as affected by a Loan Modification Agreement dated February 8, 2007, and recorded at said Registry of Deeds in Book 24655, Page 312 of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCAF Acquisition Trust is the present holder by Assignment from Bank of America, N.A., successor by merger to Fleet National Bank to MEB Loan Trust IV, U.S. Bank National Association, not in its individual capacity but solely as trustee dated October 18, 2019 and recorded at said Registry of Deeds in Book 37329, Page 168, and Assignment from MEB Loan Trust III to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCAF Acquisition Trust dated April 3, 2024 and recorded at said Registry of Deeds in Book 41720, Page 554, and Corrective Assignment from U.S. Bank, N.A., not in its individual capacity but solely as trustee, for MEB Loan Trust IV to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCAF Acquisition Trust dated March 19, 2025 and recorded at said Registry of Deeds in Book 42325, Page 330, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 84 Richard Road, Stoughton, MA 02072 will be sold at a Public Auction at 1:00 PM on October 28, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
THAT CERTAIN PIECE OF PARCEL OF LAND, AND THE BUILDINGS AND IMPROVEMENTS THEREON, KNOWN AS
84 RICHARD ROAD IN THE TOWN OF STOUGHTON COUNTY OF NORFOLK AND STATE OF MASSACHUSETTS AND BEING MORE PARTICULARLY DESCRIBED IN A DEED RECORDED IN BOOK 10241, PAGE 446.
The land with the buildings thereon in Stoughton, Norfolk County, Massachusetts, being shown as Lot 10 on a plan entitled "Section II DePaul Park, a subdivision in Stoughton, MA., Lot Layout owner and subdivided Daniel and Lily DePaul, Austin Engineering Co., July, 1963, Scale 1"-40' and recorded with Norfolk County Registry of Deeds. Said lot is bounded and described as follows:
SOUTHWESTERLY by Richard Road, 111 feet;
NORTHWESTERLY by Lot 9 on said plan, 138.11 feet;
NORTHEASTERLY by land of Charles W. Snowdale, et ux, now or formerly, 69.73 feet;
NORTHWESTERLY by land of said Charles W. Snowdale, et ux, now or formerly, 3.72;
NORTHWESTERLY again by land of Bernice M. Burbirdge, now or formerly, 27.65 feet;
SOUTHEASTERLY by land of Anne V. Femino, now or formerly, 152.62 feet.
Together with the right to use the streets and ways shown on said plan for all purposes for which streets and ways are now used in the town of Stoughton.
Said plan is recorded with Norfolk Deeds as No. 218 of 1965 in Plan Book 218
For mortgagor’s title see deed recorded with the Norfolk County Registry of Deeds in Book 10241, Page 446.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
