vs.
Carroll E. Garvin and Gail K. Garvin; JOHN DOES I-V, inclusive; JANE DOES I-V, inclusive; BLACK CORPORATIONS I-V, inclusive; WHITE PARTNERSHIPS I-V, inclusive; Unknown Heirs and Devisees of each of the above-named Defendants, if deceased, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 3rd day of September, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 10th day of February, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendants, Carroll E. Garvin and Gail K. Garvin, as follows:
The sum of $10,061.29 for the principal balance, charges, advances and expenditures. Plaintiff’s attorneys’ fees in the amount of $8,765.00; Plaintiffs’ Court costs in the amount of $1,386.29; Accruing Costs and reasonable Attorneys’ Fees incurred by Plaintiff in collecting on the Judgment, as may be awarded by the Court , including through Sheriff’s execution sale; Together with interest pursuant to A.R.S. §44-1201 on the attorneys’ fees and Court costs at the current statutory rate of 8.50 percent per annum from the date of judgment until paid; together with such advances for assessments, taxes, insurance and maintenance as are reasonably and necessarily made by the Plaintiff with respect to the premises from this date until sold as hereinafter ordered.
WHEREAS, the amount due and owing as of this date is the total of all the foregoing judgment amounts foreclosing its lien, after all setoffs and credits have been allowed is:
Judgment -- $20,212.58; TOTAL (not including post-judgment interest): $20,212.58, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot Sixty-eight (68), of DESERT MOUNTAIN PHASE II APACHE PEAK PART ONE, according to the plat of record in the office od the County Recorder of Maricopa County, Arizona, in Book 399 of Maps, page 30 and Affidavit of Correction recorded October 29, 1990, in 90-484431.
AKA: 41869 N. 111th Place, Scottsdale, AZ 85262.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 30th day of October, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
