By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Richard W. Pfingsten and Domenica F. Pfingsten to Citizens Bank of Massachusetts, dated June 19, 2007 and recorded in Bristol County Registry of Deeds in Book 6708, Page 129, of which mortgage the undersigned is the present holder for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction on October 30, 2025 at 12:00 PM local time upon the premises 37 Lincoln Avenue, Fall River, MA 02720, all and singular the premises described in said Mortgage, to wit:
THE LAND IN FALL RIVER, BRISTOL COUNTY, MASSACHUSETTS, WITH ALL BUILDINGS AND IMPROVEMENTS THEREON, BOUNDED AND DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEASTERLY CORNER OF THE LOT TO BE DESCRIBED AT THE SOUTHWESTERLY CORNER OF LINCOLN AVENUE AND BARNABY STREET: RUNNING THENCE
SOUTHERLY: BY SAID BARNABY STREET, EIGHTY-SEVEN (87) FEET TO LAND NOW OR FORMERLY OF ONE TURNER FOR A CORNER; THENCE TURNING AND RUNNING
WESTERLY: BY SAID LAST NAMED LAND, THIRTY-FOUR AND FIVE-TENTHS (34.5) FEET TO LAND FORMERLY OF CATHERINE TYNE FOR A CORNER; THENCE TURNING AND RUNNING
NORTHERLY: BY SAID LAST NAMED LAND, SEVENTY-FIVE AND THREE-TENTHS (75.3) FEET TO SAID LINCOLN AVENUE FOR A CORNER; AND THENCE TURNING AND RUNNING
EASTERLY: BY SAID LINCOLN AVENUE, FIFTY-SIX (56) FEET TO SAID BARNABY STREET AND THE POINT OF BEGINNING, CONTAINING THIRTEEN AND SIXTEEN ONE HUNDREDTHS (13.16) SQUARE RODS OF LAND, MORE OR LESS.
The premises are to be sold and conveyed "as is" subject to and with the benefit of all rights, rights of way, easements, restrictions, covenants, encroachments, building and zoning laws, liens, improvements, unpaid taxes, tax titles, water and sewer liens, municipal liens and assessments, and any other encumbrances of record which are in force and applicable having priority over said mortgage whether or not reference to such restrictions, easements, improvements, liens, encumbrances is made in the deed and will be subject to any rights of redemption for unpaid federal taxes, if any, as shall, notwithstanding this provision, constitute valid liens or encumbrances thereon after said sale, rights of tenants and parties in possession, and attorney's fees and costs if any, which take precedence over the said mortgage above described.
TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order at the time and place of sale will be required to be Paid by the purchaser in the form of certified funds at the time and place of sale. The Deposit shall be forfeited to the mortgagee if the successful bidder does not comply strictly with the terms of the Memorandum of sale. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified funds to Albertelli Law, 5404 Cypress Center Dr., Ste 300, Tampa, FL 33609. A deed will be provided to the purchaser for recording upon receipt of the full purchase price. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. The description of the premises contained in said mortgage shall control in the event of an error in this publication. By order of the present holder of said Mortgage which hereby gives notice of its intention to bid as said sale or at any adjournment or postponement thereof.
