NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Ralf Faber, Andrea Faber to JPMorgan Chase Bank, N.A., dated August 31, 2007 and recorded in the Middlesex County (Southern District) Registry of Deeds in Book 50065, Page 104 and registered at the Middlesex County (Southern District) Registry District of the Land Court as document number 1453784, and noted on certificate of title number 218926 and as affected by a judgment dated March 12, 2025 and recorded with said Registry on March 24, 2025, in Book No. 83885, at Page 239 of which mortgage the undersigned is the present holder, by assignment from:
JPMorgan Chase Bank, National Association to NewRez LLC f/k/a New Penn Financial, LLC d/b/a Shellpoint Mortgage Servicing, recorded on January 13, 2022, in Book No. 79527, at Page 117
JPMorgan Chase Bank, National Association to NewRez LLC d/b/a Shellpoint Mortgage Servicing, registered on June 2, 2025, Document No. 1978088, as noted on Certificate of Title No. 218926 and recorded on August 6, 2025, in Book No. 84458, at Page 65
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 PM on November 5, 2025, on the mortgaged premises located at 66 Solomon Pierce Road, Lexington, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The properly located in Lexington, Middlesex County, Massachusetts and more specifically described as:
REGISTERED LAND
The property, with the improvements thereon, shown as Lot 7 on Land Court Plan No. 4370F, being a subdivision of Lot 5 as shown on Land Court Plan 4370E.
All of the boundaries of said Lot 7 are determined by the Court to be located as shown on said Plan No. 4370F, as approved by the Court and filed with the Land Registration Office, a copy of which is filed with Middlesex South Registry District of the Land Court with Certificate of Title 168171 in Book 971, Page 21.
RECORDED LAND
That property, with the improvements thereon, shown as Lot 1 on a plan entitled "Pheasant Brook Estates, Lexington, Massachusetts, Subdivision Plan" dated April 2, 1984 and November 6, 1984, recorded with the Middlesex South District Registry of Deeds on June 3, 1955, as Plan 649 or 1985 in Book 16198, Page End and also shown as Lot 1 on a plan entitled "Plan or Land in Lexington, MA for Dr. John Butterly" dated December 2, 1989 by T&M Engineering Associates, 83 Pine Street, Peabody, MA recorded with Middlesex South District Registry of Deeds as Plan No. 698 of 2000, to which plans reference is made for a more particular description of said lot.
For mortgagors' title see deed registered with Middlesex County (Southern District) Registry District of the Land Court as Document No. 1145375, as noted on Certificate of Title No. 218926 and recorded with Middlesex County (Southern District) Registry of Deeds in Book 31653, Page 100.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Twenty-Five Thousand ($25,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
