THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Under and by virtue of the Power of Sale contained in a Deed to Secure Debt and Security Agreement given by Sequoia Road West, LLC to Terps Real Estate Lending, LLC, Isabel J. Bernson Declaration of Trust and Suzanne F. Bennett c/o The Bernson Group, LLC, dated March 24, 2025, filed April 3, 2025, and recorded at Deed Book 3632, Page 724, Chatham County, GA records, as last held by or assigned to Isabel J. Bernson Declaration of Trust and The Bernson Group, LLC, conveying the after-described property to secure a Promissory Note in the original principal amount of Four Hundred Eighty Thousand AND 00/100 Dollars ($480,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of CHATHAM COUNTY, Georgia, within the legal hours of sale on the first Tuesday in November, 2025, the following described Property:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE CITY OF SAVANNAH, CHATHAM COUNTY, GEORGIA, KNOWN ON THE MAP OR PLAN OF SAID CITY AS THE WESTERN FORTY-FIVE (45) FEET OF LOT FORTY-EIGHT (48), SOLOMONS WARD; SAID PORTION OF LOT HAVING A FRONTAGE OF 45 FEET ON THE NORTH SIDE OF 41ST STREET BETWEEN BARNARD AND WHITAKER STREETS WITH A RECTANGULAR DEPTH NORTHWARDLY OF 125 FEET; AND BEING BOUNDED AS FOLLOWS: ON THE NORTH BY THE WESTERN PORTION OF LOT 41, SAID WARD; ON THE EAST BY THE EASTERN 15 FEET OF SAID LOT 48, SOLOMONS WARD; ON THE SOUTH BY 41ST STREET; AND ON THE WEST BY LOT 47, SOLOMONS WARD. THIS BEING A PORTION OF THE SAME PROPERTY CONVEYED TO ATOMIC VENTURES BY LIMITED WARRANTY DEED FROM WILLIAM ERIC PHOENIX, DATED AUGUST 2, 2024, AND RECORDED IN DEED BOOK 3450, PAGE 580, CHATHAM COUNTY RECORDS.
Said property is known as 104 W. 41st Street, Savannah, GA 31401, together with all fixtures and personal property attached to and constituting a part of said property, if any.
The debt secured by said Deed to Secure Debt and Security Agreement has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Promissory Note and Deed to Secure Debt and Security Agreement. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale as provided in said Deed to Secure Debt and Security Agreement and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt and Security Agreement first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is Sequoia Road West, LLC, or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
