ORDINANCE NO. O-2023-07
AN ORDINANCE AMENDING CHAPTER 400 STORMWATER MANAGEMENT ARTICLE IV SECTION 49 MAINTENANCE AGREEMENT.
THE VILLAGE BOARD OF THE VILLAGE OF BELLEVUE, BROWN COUNTY, WISCONSIN, DOES ORDAIN THAT ARTICLE POST-CONSTRUCTION STORMWATER MANAGEMENT, SECTION 49 MAINTENANCE AGREEMENT DO HEREBY BE AMENDED
SECTION 1. Whereby the Village of Bellevue has authority to legally amend the Village Municipal Code from time to time as granted in Chapter I General Provisions.
SECTION 2. Chapter 400 Section 49 of the Village of Bellevue Municipal Code, is hereby amended to include:
D. Each applicant who was granted a stormwater management permit for a best management practice (BMP) and stormwater conveyance system, shall submit the following to the Village of Bellevue:
(1) An annual maintenance report summarizing the condition of the best management practice and stormwater conveyance system. The reports shall include all maintenance performed during the past calendar year with dates the work was completed, photos of the best management practice and receipts for any agent hired to perform the work.
(a) Where a recorded maintenance agreement exists, the annual report shall provide documentation that maintenance was performed in accordance with the inspection requirements of the recorded maintenance agreement.
(b) If a stormwater management permit was granted but no maintenance agreement has been recorded, the property owner shall work with a professional engineer currently licensed in the State of Wisconsin to create a maintenance plan and agreement. The maintenance plan and agreement are to be reviewed by the Village of Bellevue for concurrence and following concurrence shall be recorded at the Brown County Register of Deeds.
(c) The recorded maintenance agreement if not on file with the Village of Bellevue is to be submitted with the annual report.
(2) An inspection report assessing the condition of the best management practice and stormwater conveyance system as compared to stormwater management plan shall be submitted once evet)' five years. The inspection report shall be submitted and sealed by a professional engineer currently licensed in the State of Wisconsin.
(3) The Village of Bellevue or an authorized agent will provide written notice to each applicant to provide the maintenance report and or the inspection report. The notice will include a note if the Village has a Maintenance Agreement on file. The maintenance report is due to the Village of Bellevue within three (3) months of the written notice. The inspection report is due to the Village of Bellevue within six (6) months of the written notice of applicable years. The Village of Bellevue Maintenance Report template and Inspection Report template will be used to document the maintenance report. The Village of Bellevue Maintenance Agreement template will be used if a Maintenance Agreement is not on file. Non-compliance may be subject to notices of violation including fees.
SECTION 3. All ordinances or parts of ordinances, in conflict herewith are hereby repealed.
SECTION 4. This ordinance shall take effect upon its adoption and publication.
