Permitted Activity: Storm water discharges to waters of the state from municipal separate storm sewer systems (MS4) that are owned, operated, and maintained by municipalities listed above.
Discharge Locations: From the municipal separate storm sewer systems of the City of Racine, City of New Berlin, City of Franklin, Village of Greendale, Village of Hales Corners, Village of Mount Pleasant, Village of Caledonia.
Receiving Waters: Waters of the state located within the Root River, Fox River, Pike River, Oak Creek, Menomonee River, and Lake Michigan Watersheds.
Department of Natural Resources Determination: The Department has made a preliminary determination to reissue WPDES Permit No. WI- S050059-4. Requirements and conditions to protect the waters of the state in accordance with applicable state statutes and administrative codes are included in the proposed permit.
WEPA Compliance Determination under s. NR 150.35(2), Wis. Adm. Code: Reissuance of WPDES Permit No. WI- S050059-3 is a prior compliance action under s. NR 150.20(3)(a)8., Wis. Adm. Code.
Nature of Discharges Covered by the Permit: The proposed permit contains the requirements set forth under Ch. NR 216, Wis. Adm. Code, and the developed urban area performance standard specified in Ch. NR 151, Wis. Adm. Code. The proposed permit applies to discharges to waters of the state throughout the state of Wisconsin.
Permit Description (WPDES Permit No. WI- S050059-4): The Department proposes to cover the storm water discharges for the City of Racine, City of New Berlin, City of Franklin, Village of Greendale, Village of Hales Corners, Village of Mount Pleasant, Village of Caledonia under Permit No. WI-S050059-4 after it is reissued. The MS4 permit requires a regulated municipality to reduce pollutants that discharge through its MS4 to waters of the state via the development, implementation, and maintenance of programs for public education and outreach, public involvement and participation, illicit discharge detection and elimination, construction site pollutant control, post-construction pollutant control, pollution prevention at its municipal operations, and meeting the developed urban area performance standard under Ch. NR 151, Wis. Adm. Code. In addition, the permit requires the development and updating of a storm sewer system map and an annual report to the Department. Furthermore, the proposed permit specifies special conditions to address the Milwaukee River TMDL goals.

All written comments may be submitted via mail, e- mail, or hand delivered. All comments received no later than 4:30 p.m., November 15, 2025, will be considered along with other information on file in making a final decision regarding the proposed permit.
The Department may schedule a public informational hearing if requested by any person. The Department shall schedule a public informational hearing if a petition requesting a hearing is received from 5 or more persons or if response to this notice indicates significant public interest pursuant to s. 283.49, Wis. Stats. A request for a public informational hearing shall state the following: The name and address of the person(s) requesting the hearing; the interest in the proposed permit of the person(s) requesting the hearing; the reasons for the request; and the issues proposed to be considered at the hearing.

In addition, copies of the proposed permit and fact sheet may be obtained by contacting the Permit Drafter indicated above. Reasonable costs will be charged for copies of information in the file other than the public notice, permit, and fact sheet.
