THE M.P.R. HOMEOWNERS ASSOCIATION, an Arizona non-profit corporation, Plaintiff(s),
vs.
MELANIE J. MANDELIN, a single woman; BOFA MERRILL LYNCH ASSET HOLDINGS, INC., Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 12th day of August, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 6th day of March, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, Melanie Mandelin, as follows:
The principal amount of $3,958.18 plus accruing semi-annual assessments of $208.00 or such greater amount as Plaintiff may assess in the future as a lien on the Property, together with interest thereon at the rate of 12% per annum from the date the judgment until paid in full; For the principal amount of $4,206.74 plus accruing semi-annual assessments of $208.00 and late fees of $20.00 or such greater amount as Plaintiff may assess in the future against Defendant Melanie J. Mandelin personally pursuant to the Declaration, together with interest thereon at the rate of 12% per annum from the date of the judgment until paid in full; For The M.P.R. Homeowners Association’s reasonable attorneys’ fees in the amount of $3,957.00 and court costs in the amount of $1,186.69, together with interest thereon at the rate of 8.5% per annum from the date of judgment until paid in full against Defendant Melanie J. Mandelin; For pre-judgment interest on the principal amount at the rate of 12% in the amount of $474.98; For pre-judgment interest on the principal amount at the rate of 12% in the amount of $504.81; For M.P.R. Homeowners Association’s reasonable attorneys’ fees, costs and expenses incurred in executing upon the Judgment including, but not limited to, all attorneys’ fees, costs and expenses incurred in scheduling and conducting the sale and, if necessary, obtaining possession of the Real Property, recording any subsequent deed, and costs to repair and sell the Real Property, upon application to the Court, satisfaction of all amounts due to The M.P.R. Homeowners Association of Phoenix presently in the amount of $10,169.72. This amount was reached by adding the Judgment, which totals $9,576.85, post-judgment assessment of $208.00, and post-Judgment interest of $384.87 to August 7, 2025, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to-wit:
Lot 26, SAGUARO POINT, according to Book 274 of Maps, Page 17 and Certificates of Correction recorded in Document No. 86-667218, records of Maricopa County, Arizona.
EXCEPT all minerals, ores and metals of every kind and character and all coal, asphaltum, oil, gases, fertilizers, fossils and other like substances in or under said land as reserved in the Patent of said land.
AKA: 3925 E. White Aster Street, Phoenix, Arizona 85044.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 6th day of November, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs
