NOTICE OF FORECLOSURE SALE
WHEREAS, Quality Clean Construction, LLC, a Tennessee limited liability company, and Edward Monroe Simmons, Jr. (collectively, the “Grantor), executed that certain Deed of Trust, dated May 25, 2022, to David G. Mangrum, Trustee (“Original Trustee”) for the benefit of Grassland Financial Services, LLC (the “Original Lender”) of record as Instrument No. 20220601-0063069, Register’s Office for Davidson County, Tennessee (the “Deed of Trust”), to secure certain indebtedness as therein described (the “Indebtedness”); and
WHEREAS, Equity Trust Company, as custodian for benefit of the Caroline Jenkins Roth IRA bearing account number XXXXX1158 (“Equity Trust Company”), successor in interest to Original Lender, is the current owner and holder of the Indebtedness secured by said Deed of Trust; and
WHEREAS, C. Tucker Herndon and Gregory Vick have been appointed Substitute Trustees by Equity Trust Company, by instrument of record as Instrument No. 20250918-0074450, Register’s Office for Davidson County, with authority for any one of such Substitute Trustees to act alone or by a designated agent with the powers given the Trustee in the Deed of Trust and by applicable law; and
WHEREAS, default has occurred under the Deed of Trust, and the Indebtedness has been declared due and payable, and the Indebtedness has not been paid; and
WHEREAS, Equity Trust Company, the owner and holder of the Indebtedness, has demanded that the real property be advertised and sold in satisfaction of said Indebtedness and the cost of the foreclosure, in accordance with the terms and provisions of the loan documents and Deed of Trust.
NOW, THEREFORE, notice is hereby given that Substitute Trustee, or a designated agent for the Substitute Trustee, pursuant to the power, duty and authority vested in and conferred upon the Trustee by the Deed of Trust and applicable law, will on November 5, 2025 at 12:00 PM at the front door of the Davidson County Courthouse, One Public Square, Nashville, Tennessee 37201, offer for sale to the highest bidder for cash, and free from all rights of redemption afforded by statute, equitable rights of redemption, exemption of homestead, and all other exemptions of every kind, all of which have been expressly waived and relinquished by Grantor in the Deed of Trust, the following real property located in Davidson County, Tennessee (the “Property”):

Being a certain parcel of land in the First Civil District and the Third Council District of Metro Nashville & Davidson County, Tennessee and being more particularly described as follows:
Beginning at an iron pin found in a TVA Easement, said iron pin being the southwesterly corner of the Webb property, of record in Instrument Number 20020131-0013599; said point also being an easterly corner of the Terminal Logistics II FXG Ground SPE, LLC property, of record in Instrument Number 20210119-0007430; thence with Terminal Logistics II FXG Ground SPE, LLC’s westerly line S 59°04’36” W a distance of 607.84 feet to a T-Post found and crossing the center of a TVA Easement at 78.90 feet; said T-Post being in the northeasterly corner of Willow Trace, Phase Two N 49°30’15” W a distance of 461.72 feet to an iron pin set, set point being southeasterly corner of the Prestwick Place Subdivision, Plat Instrument Number 20040723-0088164; thence with the easterly line of Prestwick Place N 38°15’52” E a distance of 636.77 feet to a T-Post found, said point being in the southwesterly line of Webb, aforementioned the following two calls: S 84°08’14” E a distance of 238.38 feet to an iron pin found; thence S 27°30’02” E, crossing the center of a TVA Easement at 503.94 feet, a total distance of 522.09 feet back to the point of beginning and having an area of 9.197 acres (400,640 square feet) according to a survey conducted by Crow Land Surveying on May 12, 2021.
Being the same property conveyed to Quality Clean Construction, LLC by Warranty Deed from Ricky Earps of record in Instrument No. 20220506-0052581, Register’s Office for Davidson County, Tennessee, dated April 29, 2022 and recorded on May 12, 2021.
Further being the same property conveyed to Grove Park Ventures, LLC, a Tennessee limited liability company, as to 50% undivided interest by Quitclaim Deed from Quality Clean Construction, LLC, a Tennessee limited liability company of record in Instrument No. 20250314-0018791, Register’s Office for Davidson County, Tennessee, dated March 11, 2025 and recorded on March 14, 2025.

As to all or any part of the Property, the right is reserved to (i) delay, continue or adjourn the sale to another time certain or to another day and time certain, without further publication and in accordance with law, upon announcement of said delay, continuance or adjournment on the day and time and place of sale set forth above or any subsequent delayed, continued or adjourned day and time and place of sale; (ii) sell at the time fixed by this Notice or the date and time of the last delay, continuance or adjournment or to give new notice of sale; (iii) sell in such lots, parcels, segments, or separate estates as Substitute Trustee may choose; (iv) sell any part and delay, continue, adjourn, cancel, or postpone the sale of any part of the Property; (v) sell in whole and then sell in parts and consummate the sale in whichever manner produces the highest sale price; and/or (vi) to sell to the next highest bidder in the event any high bidder does not comply with the terms of the sale.
Neither Substitute Trustee nor Lender will make any covenant of seisin, marketability of title or warranty of title, express or implied, and will sell and convey the Property by Substitute Trustee’s Quitclaim Deeds from Substitute Trustee.
This sale is subject to all matters shown on any applicable recorded plat or plan; any unpaid taxes and assessments (plus penalties, interest, and costs) which exist as a lien against Property; any restrictive covenants, easements or setback lines that may be applicable; any rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any governmental agency, state or federal; and any and all prior Deed of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this foreclosure sale. This sale is also subject to any matter that an inspection and accurate survey of the property might disclose.
Lender has the right to bid at the sale, including making a credit bid. Lender shall have the right to become the purchaser at the sale, and Lender shall have the right to credit upon the amount of Lender's successful bid, to the extent necessary to satisfy such bid, all or any part of the secured indebtedness in such manner and order as Lender may elect.
