PNC BANK, NATIONAL ASSOCIATION, is the Plaintiff, and LESLIE F. LEIBOWITZ, ET ALS., are Defendants, writ of execution for the sale of mortgaged premises dated 08/29/2025.
By virtue of the above stated Writ, to me directed and delivered, I will expose to sale at public vendue on WEDNESDAY, the 19TH DAY of NOVEMBER A.D. 2025, at the hour of one thirty o' clock by the then prevailing (Standard or Daylight Saving) time, in the afternoon of the said day, at the Heldrich Hotel, 10 Livingston Ave, New Brunswick, N.J. 08901.

THE ESTIMATED GOOD FAITH UPSET AMOUNT PURSUANT TO NJSA 2A:50-64(12)(5)(a) IS $152,602.62. (BASED UPON A PROJECTED SALE DATE OF November 19, 2025)
PLANTIFF IS UNABLE TO ASCERTAIN THE OCCUPANCY STATUS OF THE PROPERTY.
Please include the following exceptions in the sale notice:
A. SUBJECT TO ANY UNPAID TAXES, MUNICIPAL LIENS OR OTHER CHARGES, AND ANY SUCH TAXES, CHARGES, LIENS, INSURANCE PREMIUMS OR OTHER ADVANCES MADE BY PLAINTIFF PRIOR TO THIS SALE. ALL INTERESTED PARTIES ARE TO CONDUCT AND RELY UPON THEIR OWN INDEPENDENT INVESTIGATION TO ASCERTAIN WHETHER OR NOT ANY OUTSTANDING INTEREST REMAIN OF RECORD AND/OR HAVE PRIORITY OVER THE LIEN BEING FORECLOSED AND, IF SO, THE CURRENT AMOUNT DUE THEREON.

C. SUBJECT TO A FIRST MORTGAGE IN THE AMOUNT OF $150,000.00, DATED JULY 29, 2010, EXECUTED BY LESLIE F. LEIBOWITZ, A SINGLE PERSON TO WELLS FARGO BANK, N.A., RECORDED AUGUST 4, 2010, IN BOOK 13932, PAGE 0175. SAID MORTGAGE WAS ASSIGNED TO SPECIALIZED LOAN SERVICING LLC, BY ASSIGNMENT OF MORTGAGE DATED JULY 7, 2023, RECORDED JULY 10, 2023, IN BOOK 19247, PAGE 482. SAID MORTGAGE WAS MODIFIED BY A LOAN MODIFICATION AGREEMENT MADE ON JULY 26, 2024, RECORDED AUGUST 29, 2024, IN BOOK 19534, PAGE 1707, CHANGING THE PRINCIPAL BALANCE TO $115,566.35.
D. SUBJECT TO SPECIAL CHARGES FOR OPEN UTILITIES IN THE AMOUNT OF $62.87 PLUS PENALTY AND INTEREST FROM 08/22/2025.
THE SHERIFF HEREBY RESERVES THE RIGHT TO ADJOURN THIS SALE WITHOUT FURTHER NOTICE THROUGH PUBLICATION
SURPLUS MONEY: If after the sale and satisfaction of the mortgage debt, including costs and expenses, there remains any surplus money, the money will be deposited into the Superior Court Trust Fund and any person claiming the surplus, or any part thereof, may file a motion pursuant to Court Rules 4:64-3 and 4:57-2 stating the nature and extent of that person's claim and asking for an order directing payment of the surplus money. The Sheriff or other person conducting the sale will have information regarding the surplus, if any.
The approximate amount of the upset to be satisfied by said sale is the sum of ONE HUNDRED THIRTY SEVEN THOUSAND EIGHT HUNDRED SIXTY SEVEN DOLLARS AND THIRTY FIVE CENTS ($137,867.35) dollars more or less, plus interest together with the costs of this sale. THE UPSET AMOUNT MAY BE SUBJECT TO FURTHER ORDERS OF ADDITIONAL SUMS.
The subscriber reserves the right to adjourn said sale from time to time subject only to such limitations or restrictions upon the exercise of such power as may be specially provided by law or rules of the Court. Sold subject to conditions of sale.
Successful bidder must pay 20% of bid in cash (up to $1,000.00), certified check or official bank check at close of sale and the balance in two weeks.
