FORECLOSURE NOTICE
WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Mortgage from DOROTHY ANN BALL, A MARRIED WOMAND AND HUSBAND CLARENCE BALL to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS MORTGAGEE, AS NOMINEE FOR HOMECOMINGS FINANCIAL NETWORK, INC., on the 22nd day of October, 2001, said mortgage recorded in the Office of the Judge of Probate of Etowah County, Alabama, on October 30, 2001, at Instrument Number M-2001-4754, Etowah County, Alabama Records, said Mortgage having subsequently been transferred and assigned to U.S. Bank National Association, not in its individual capacity but solely as Trustee of the NRZ Pass-Through Trust XI, by instrument recorded in the aforesaid Probate Office; notice is hereby given that the undersigned U.S. Bank National Association, not in its individual capacity but solely as Trustee of the NRZ Pass-Through Trust XI, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash at the Main Entrance to the Etowah County Courthouse, 800 Forrest Avenue, Gadsden, AL 35901 in Gadsden, Etowah County, Alabama, on November 19, 2025, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Etowah County, Alabama, to-wit:
LOT NUMBER 2 AND A TRACT OF LAND DESCRIBED AS BEGINNING AT THE NORTHWEST CORNER OF LOT NUMBER 2, AND FROM THENCE RUN IN A SOUTHERLY DIRECTION ALONG THE WEST LINE OF SAID LOT A DISTANCE OF 74 FEET; THENCE IN A NORTHERLY DIRECTION, IN A DIRECT LINE, TO A POINT IN THE NORTH LINE OF LOT NUMBER 1, WHICH SAID POINT IS 12 FEET WESTERLY, MEASURED ALONG THE NORTH LINE OF SAID LOT NUMBER 1, FROM THE NORTHWEST CORNER OF LOT NUMBER 2, THENCE IN AN EASTERLY DIRECTION ALONG THE NORTH LINE OF SAID LOT NUMBER 1 A DISTANCE OF 12 FEET TO THE POINT OF BEGINNING, SAID DESCRIPTION EMBRACING A PORTION OF LOT NUMBER 1, ALL THE ABOVE BEING IN BLOCK NO. 2 IN THE HIGHLANDS TO GADSDEN ACCORDING TO MAP THEREOF RECORDED IN PLAT BOOK "C", "PAGE 263", IN THE OFFICE OF THE JUDGE OF PROBATE OF ETOWAH COUNTY, ALABAMA, AND BEING AND LYING IN THE CITY OF GADSDEN, ETOWAH COUNTY, ALABAMA, TOGETHER WITH ALL IMPROVEMENTS LOCATED THEREON, AND BEING ONE AND THE SAME PROPERTY DESCRIBED IN THAT CERTAIN DEED RECORDED IN BOOK 1997, "PAGE 196", DOCUMENT NUMBER D-1997-2986, IN THE OFFICE OF THE JUDGE OF PROBATE OF ETOWAH COUNTY, ALABAMA.
Said legal description being controlling, however the property is more commonly known as 1121 HILLSBORO DR, GADSDEN, AL 35903.

This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate in the county where the above-described property is situated. This property will be sold subject to the right of redemption of all parties entitled thereto and subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable). This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
