MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Donna L. Laviolette to World Savings Bank, FSB, dated November 30, 2006 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 40285, Page 341 (the “Mortgage”), as affected by a Loan Modification Agreement dated January 4, 2023, and recorded at said Registry of Deeds in Book 68855, Page 348 of which mortgage Wells Fargo Bank, N.A., is successor by merger to Wells Fargo Bank Southwest, N.A. F/K/A Wachovia Mortgage, F.S.B. F/K/A World Savings Bank, F.S.B. is the present holder, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 11 Gay Road, Brookfield, MA 01506 will be sold at a Public Auction at 1:00 PM on November 12, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
That certain parcel, with the buildings and improvements thereon situated in Brookfield, Worcester County, Massachusetts being shown as Lot 2 on a "Plan of Land in Brookfield, Massachusetts, surveyed for LTD Investments" by Para Land Surveying, Inc., dated July 28, 1987 and recorded in the Worcester County Registry of Deeds in Plan Book 588, Plan 125, bounded and described as follows:
BEGINNING at an iron pin located on the westerly side of said Gay Road at the northeasterly corner of said lot and at the southerly corner of Lot 3 as shown on said plan;
THENCE N. 65 degrees 26' 36" W. along Lot 3 as shown on said plan, 210.00 feet to an iron pipe;
THENCE N. 20 degrees 52' 21" W. along Lot 1 as shown on said plan, 90.00 feet to an iron pipe;
THENCE S. 03 degrees 29' 23" W. along Lot 1 as shown on said plan, 466.84 to a point;
THENCE N. 34 degrees 50' 42" E. along a stone wall and along land now or formerly of Mynott Newton, 181.62 feet to a plastic stake in a stone wall;
THENCE N. 35 degrees 15' 41" E. along a stone wall and along said Newton property, 198.79 feet to an iron pin in a stone wall on the westerly side of Gay Road;
THENCE 09 degrees 53' 10" E. along a stone wall and along the westerly side of said Gay Road, 26.38 feet to a point;
THENCE N. 12 degrees 46' 09" E. along the westerly side of Gay Road, 128.62 feet to the iron pin at the point of beginning.
Containing an area of 1.668 acres, more or less.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 34157, Page 302.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
