PUBLIC AUCTION SALE by virtue of cancellation of the Proprietary Lease and/or stock certificate executed by MIDLAND AVENUE OWNERS CORP. as Lessor and OTILIA CABALLERO and JAMES H. SEABURY, as Lessee, listed below and based upon the Shareholders’ default in the payment of cooperative maintenance, I, MATTHEW D. MANNION, Auctioneer, NYC DCA # 1434494 or John O’Keefe, Auctioneer, NYC DCA License No. 2103965, will sell at public auction to the highest bidder, shares of the property consisting of the Capital Stock and all of the right, title, and interest in and to the proprietary lease as set forth below on NOVEMBER 5, 2025 at 9:00 A.M. at the foreclosure alcove located after security in the first-floor lobby of the Westchester County Courthouse located at 111 Dr. Martin Luther King Jr. Blvd., White Plains, New York:
a. 312 shares of the capital stock of MIDLAND AVENUE OWNERS CORP. appurtenant to Apartment L2 at 1296 MIDLAND AVENUE, YONKERS, NY 10704. The amount due as of the date of this notice is $16,153.50.
ALL SALES are "as is" and are without representation. Said sale is subject to any prior liens of record, to the rights of tenants in possession, if any, consent of the Corporation, payment of all fees and expenses of the sale, additional maintenance, flip tax, auctioneer's fees, and are further subject to the terms of sale which will be available for review prior to the start of the auction. Said Terms of Sale provide that any bidder must take title in his/her own name for actual occupancy by the named bidder. The secured party reserves the right to bid.
